Can you receive financial aid or student loans if you owe taxes to the IRS?
I am not 100% positive about the details, but my friend inherited some money from her Mom when she died, and I think some of it was in some sort of investments, and when she took it out, she never paid taxes. They told her she owed something like $20,000 in taxes with fees and penalties, so she's been paying a little every month (and they want to jack up the payments in 2012 when her car is paid off). I was telling her that she should go back to school, that you don't need good credit to get financial aid or student loans. She's worried that she won't be able to get a student loan because she owes the IRS....is this true? I was telling her that she should get a tax lawyer, but she said she assumes she can't afford one....any good advice? I feel SO bad for her because I want to go back to school to get a second degree (and I have no problems except not so great credit), and I want her to move with me and make her life better too! Please say there is a way! I don't want to disappoint her!

for financial aid she probably will have to present some kind of documentation of her income ie. her tax returns and the unpaid taxes will probably be evident
it is not likely this will be held against her since, she definitely would be in need of financial aid

1. You only need a tax attorney if you are under criminal indictment for a tax related crime. While some do prepare tax returns as well, you'd be bringing a howitzer to a knife fight where a Saturday night special would be sufficient.

2. Owing the IRS won't affect her eligibility for student loans or financial aid. The IRS has a vested interest in her improved earnings capacity for what should be obvious reasons.

3. The only time that the IRS gets involved is if she has unpaid student loans in default. Any tax refunds would be at risk for offset to pay down the debt. However since she already has a tax debt that she'd dealing with, the IRS always comes first so that's a moot point.

4. If she has $20k in debt from an inherited tax-deferred account that she did not declare as income when she took the distributions, she should consider selling whatever it was that she bought with those funds and paying off the IRS in full. Even if part of that is penalties and interest, she still had to have blown well into 5 figures to generate that much tax liability.
