yesterday was the last day to turn in your taxes, and my step father waited until yesterday to turn his in and it came back rejected because my mom and him both claimed my sister. I did my moms taxes for her this year and i assumed since my sister lives with my mom and my mom pays for everything for my sister that the EIC would go to her. well I guess its supposed to go to him because of some divorce agreement. So my moms taxes have been done for a while now, Would I have to redo them and she would have to send back a certain amount of money to the government? So that he can claim her? How would I redo her taxes if thats what I have to do?
Yes, you'll have to file an amendment to her return, dropping the exemption for your sister. You use a form 1040X for that.
Your mom gets the EIC for her though since your sis lives with mom - the divorce agreement can dictate who gets the exemption, but not EIC.
Your mom might have to send back part of her refund, if she saved in taxes by claiming your sister's exemption. She won't have to send back the EIC part though.

You will need to request a Form 1040X and complete and resubmit it.
There are 3 columns to fill out.
Column 1 is for what you previously submitted
Column 2 is for the corrected information
Column 3 shows the difference between the two

Yes, you can amend them. Since your mom claimed some of the credits that according to the divorce decree she should have not, she will need to amend her return to correct it. Your step father will not be able to send taxes electronically anymore since you sister was claimed by your mom already. He will need to mail his return just like it is if he is entitled to the credits. And your mom amend her return to correct it and mail it too.
