You could, but you will still owe the taxes on the income from that job, and you will need to submit an amended tax form (1040X) as soon as you get the missing W2. If you don't submit the proper forms, including *all* your income from *all* your W2s, before the due date of 15 April, you will be subject to interest and penalties as well as any actual tax due on the missing form.
You could estimate the amount from that W2 by using the information from your last pay stub. That way, you won't have to worry about any penalties.
Your employer should have given you that W2 by January 31. Have you called the IRS and reported them? |

If you efile, you don't need to send in your W2, but you will need to enter in the EIN for your employer if you do it this way. Good Luck. |

So long as you know your wages and withholdings and include those in the numbers you report on your tax forms, you should be OK.
You may be able to ask for a duplicate from your employer. |

Did you receive a W2 and lost it or did the Company not send it to you yet? By law all employers are required to mail them no later than 1-31. Call the company and find out if they mailed it. If not, report them to the IRS. Don't send in your taxes without all the documents. If you still don't get the w2 from your employer the IRS can give you a similar statement used for filing your taxes. I had to do that. Good Luck to you. |

You have to show that you made a best effort to obtain your w-2's from your former employer. You'll have to prepare a letter and mail it to them certified. A copy of that letter will need to be included in your tax return. Then you'll need to prepare an estimated w-2 based upon your final paystub from that company, and then you would be able to file after those two things are complete. |

If you are efiling and have your last paystub you should be ok. I recommend you wait for your W-2 though. If you are mailing your return in and for some reason you can't get your w-2 from your employer than you can attach Form 4852 "Substitue for form W-2 wage and tax statement". Go to www.irs.gov and click forms and publications, then click form and instruction number and a list of forms in numerical order will pop up. Select it and print it out and fill it in with the info from your last paystub. |

you can do a easy and cheap way by going to www.completeshield.net to do you tax online it's only $29.99 and it's really easy, i did my tax online with them and all you do is put some information in and the computer does that rest. good luck |
