There is a test case currently in the courts, so until this is resolved the banks are not paying back charges, and indeed are still issuing them.
You can complain, then your bank will hold you on file until the judge has made a decision on whether or not these charges are fair. If the judge decides that the fees are not proportional then the banks will refund the people who have submitted a claim. If the decision goes the other way, no money will be returned and the charges will continue.
There is no date confirmed for the decision.
Send in your letter of complaint. You may well get your money back, if you dont then there is no harm in asking! |

Anyone who has put in a claim with their bank will have to wait until the ruling from the FSA case against the banks. The case has been adjourned I think so who knows when it will be. |

An on going case in the High Court has temporarily put a stop to this pending the judgement later this year. If the banks win then no-one will get any of the money back, if they lose then you will be able to get some if not all of your money back.
The Office of Fair Trading is bringing the case and it is likely that the case may take a full year before a judgement is known. As a temporary measure the Court has ordered that no more charges should be paid back until after the judgement. |
