i lived in my home for 4 years with my children (the house was owned by a trust as i was the beneficiary),after 4 years the trust and i agreed to terminate the trust and sell the house.we sold house for £250000 from the turst income i recieved £145000 to purchase alternative home and was registered deeds in my name so the property would be mine.the remainder of the money from the sale of the trust home was used to pay accountant fees/solicitor fees etc and the last amount i recieved was £97,000 .the solicitors and accountants have stated that no capital gains tax is due as the property sold was my main home .are they correct as i am worried that the tax man may come calling after i have spent my money(years later). |

they are correct, you cannot be taxed capitol gains on the sale of a property you live in, it is very different however if you own multiple properties that you sell, but dont live in.
PS - EVeryone who has ever worked with or for the tax office deserves a hidious death in searing pain. |

You definitely don't have to pay capital gains on your main home under normal circumstances. |

No CGT is payable on your own home, otherwise there would be a national riot.
Also as you received all the proceeds for the house, bar the Professional Fees etc...it doesnt matter whether its in trust or not as it is treated as you owned the house anyway.
If however the proceeds were to be split between you and other family members then their part could be liable to CGT but not yours as you lived in it. |

The Trustees have no CGT liability, but it's NOT because you live in the house. |

Your advisors are correct. As the main beneficiary of the trust, you occupied the house as your only or main residence and so there is no CGT to pay. Even if there was, it would be the Trustees' liability, not yours, but there is no CGT on this transaction. |

I think that your Solicitors are right that there is no Capital Gains Tax to pay. For your own peace of mind, I suggest that you write to the Taxman, giving all the details and ask them to confirm that there is no tax is due. You could also write to the Solicitors, asking them under what legislation you would be exempt, but that would involve some cost.
