Additional Details For all you asking y i dont work. I have been off work for the past year because i was a victim of a drunk driver witch am still recovering from. Also i dont really have any bills besides rent, which is cheap. We have a cute little house , 1 reliable car for summer , and 1 reliable suv. for winter. Also my fiance and i remodel this old home for his mother which she pays us with.

Since you have no income you will not need to file, there is no tax to pay or receive a refund from. |

If child support was your only income, you can't get any tax benefit from claiming your daughter, since you have no income to report. Child support is not reported.
If you are thinking of something like EIC, that's only for people with earned income, and you don't have any so you don't qualify. |

Unless there is a divorce decree saying that you must give the exemption to your child's father you can claim your daughter. However, child support is not taxable, so your child will give you a zero tax benefit if your claimed her.
If you either get along with your child's father or are if he is behind in his payments, fill out Form 8332 "Release of Claim of Exemption for Child of Divorced of Separated Parents". The will allow the father to claim your daughter, this will allow him to get a bigger refund on his tax return. This will make you either a nice person or increase his refund so he can pay more child support.
When you start getting earned income your tax situation will change and will want to seek further advice. |

When I went to do my taxes for the first time after my divorce,I had my paperwork ready to go, when the tax person told me that I do not claim child support. The tax person told me that children do not pay taxes and that is the child's money, and you do not pay taxes on money that has already been taxed. As far as claiming her you have every right to claim her as long as her primary residency is with you and you can prove that you paid out more for her than you received from child support. My attorney told me that I got to claim my daughter because my child support payments did not exceed more than I made at my job. So really since your child support is your only income, I would say no you can not claim her, because your income did not exceed the child support. In addition, child support is really the child's money not ours. I use mine to help with the bills, but the rest goes to her. |

Ok i work for Liberty tax service as a marketing manager but i have taken the tax classes. What i have learned is that child support cannot be counted as income even though it is it is not earned income. You cannot file a return if you have not had a tax paying job. If you have and you have paid more than half of the support for her (51% or more) then you can claim head of household as long as she has not made more the $3400 dollars. I don't know her age so that may not be the case. Basically it wont help you if childsupport was your only income you cannot get the EIC for her without a tax paying job or recieved a 1099-r form from a previous employer, w-2g from a casino, or a w-2 from an employer. hope this information helps you. The person who pays you child support pays taxes on that.
You don't owe anything and shouldn't be entitled to a refund since you didn't earn any income (passive or active).
Why don't you work, if I may ask? Aren't you bored? Don't you need to get out? I know it's none of my business but this sounds like a nightmare to me. |

Yes you can claim your daughter if you provide more than 75% of her support and she lives with you year round(this doesn't count visitation with father if it's in a divorce or court settlement). |

To claim a child, you have to want them to LOVE with all you got, even if you have to get a job! Sometimes people loose jobs or die real young; so you may not get surport as long as you are dreaming of. You don't know the furture. Face your truth.
If you don't really care about the child, then leave it with the other one. |

I think you can claim child support as income. It is counted as income for most people I know. Yes it will benefit you as long as no one else can claim the child. |
