Child support question?
My daughter will be 2 in June. Since she has been born I've received maybe 5 months of child support. So I am owed almost $5,000 according to the courts. My ex is saying they might give me his entire tax refund check because of this..Is this possible? Have any of you ever received your ex's whole tax return because of unpaid child support?

They will only take his state income tax refund, not his federal. They will take all of his state refund every year until he is paid up. My daughter's father is over $11,000.00 in arrears. I should say it also depends on the laws of the state your in. I am in New York State. It sounds like you feel bad about them taking the whole thing? Please remember he owes it to you and your child. yes - you might receive the whole refund - unless he owes for the babies birth - or owes the gov'm anything - because according to them - they come first. and yes, it would take months to receive the money.

Yes, you will receive ALL of his refund if his arrears equal his refund. It does not take 9-10 months. Depending on where you live, they will give you both Federal and State depending on how much he owes.

It is definitely possible, since you, through the court, have a prioritized interest in his refund. The government frequently uses tax refunds to satisfy prioritized claims.

If he is behind on paying his child support, the courts will take his tax refund and yes you will get it.

Yes they can and most likely will attach his tax refund for back child support.

You can go to the IRS web site and check out the rulings on this.

Yes it is very possible. Or they could go to jail and the only way to get out is to pay Back child support!

Yes, you could get his entire tax return. If he is getting back more than he owes you, he'll get the difference. If he owes more in back support than his refund is worth, he won't get a penny, you'll get it all. They can take a federal tax refund if you are $500 behind in child support. They'll take as much of it as they need to, to cover every penny that they can of back support.

No it shouldn't take 10 months. The average is 4. When the IRS offsets a tax return for back support, they automatically hold the offset funds for about 3 months. Just in case there is an injured spouse form filed. Sometimes if there is no one else on the return, they'll hold it for less time and "release" it sooner, but that is at their discretion. Holding it makes it easier to recover just in case all of it or a portion of it wasn't really supposed to go to child support due to a number mix up, or a portion of the return is due to a new spouse. Then after the "waiting" period the IRS sends it to the child support office that requested it, then the cs office credits the account, and then sends it to you like any other normal payment. You'll get it all in one big lump sum too, the cs office won't divy it up over several months or anything like that.

So yes, it's possible, it's become a common thing in today's society, and you will get it.

I have been paying child support arrears through tax withholding for 6 years...yes I was a deadbeat parent and trust me I am ashamed to admit it...however, I will finally get a partial return this year and finally paid in full!!...Yes if he owes over 500 in ANY state, they will take his federal and state until he is paid up. They will send him the difference...also it does NOT take 9 or 10 months...if this happens your county CS office is not doing their jobs approriately and I think they are defintely approving. Good luck if he owes you you and your child deserve it
