Claiming child on income tax?
this is going to be my first year that i claim my son. him being only seven months... my question(s) are, roughly, how much do you get per child... and recently my gf said that she is entitled to half of what i get.. being that shes the one that takes care of our son while im off at work. not only that she said that if i dont agree to give her half, i cant get it at all. she told me that i cant claim my son without her signature or approval.. is this true?
is it really up to her if i get to claim him. or can i do it anyway and get my tax refund with out her consent?

Only one of you can claim your son. If the child lives with you and her in one place, and you can show you paid over 50% of his support, than you can claim the child. If however the child lives with her and you cannot show you paid 50% of the support, then you cannot claim him as your dependent without her written authorization, or a court document.

You are entitled to a $3,400 exemption for the child and a $1,000 child credit against tax due. Nobody else is entitled to anything. If you want to share the money with someone, that is your business.

From your question you sound like you, your gf and the baby all live together. If you live with the baby then you don't need her permission or signature to claim him - you'd only need that if he lived with her but not with you.

How much you get for him depends on how much you make for the year. It could be anywhere from zero up to several thousand dollars - probably would be something at least. Post again with your income and somebody can give you a better estimate. Also say who you live with, who your gf lives with and who the baby lives with.

You get $1,000 deduction for each child, and an additional $3,400 exemption.. but it also depends on what you earned that year. There are worksheets you have to do in form 1040 in order to see what your adjusted amount would be, if any. On a good note, if you didn't make that much money in 2007, you may also qualify for the EIC (Earned Income Credit) on line 66a of form 1040. You get a credit for example.. if you only made $16,000, your refund would be about $2,700 that the government pays you, regardless of how much withholding you had in 2007 from W-2 employement. Hope this makes sense.
Your girlfriend is not entitled to anything.. but you need to be the provider for that child to claim him as a dependent.. more than 50% provider is the legal standard. You and your girlfriend cannot both claim the same dependent.

EID: Adding to MoBs response, you can claim head of household but only if that child was born before July and lived with you 50% of the year (that is 6 months) otherwise you can't do head of household this year.

Your info says that you've provided the financial support for both your gf and your son. If your son has always lived with you and he did not provide more than half of his own financial support (kind of difficult at seven months!), then you are eligible to claim him as a dependent. Your gf cannot.

If you pass the "lived with you / you provided the support" tests above, that is all that is required for you be able to claim your son. Your gf is absolutely incorrect when she states that you can't claim him without her signature or approval.

You do not need her signature or her approval. I would point out that if you each file a tax return and BOTH of you claim your son, this will raise a red flag with the IRS and they will ask EACH of you to prove that you provided the financial support for the child, and whoever cannot prove that will be in some additional hot water with the IRS.

If you are claiming your son and are not married, you should file as "Head of Household" and then claim your son, entering his social security number where indicated on your tax return.

Filing as Head of Household will give you a larger exemption, which will reduce your tax liablity and either decrease the amount you owe or increase the amount you get back.

Claiming your child will give you another exemption, and will also allow you to claim a Child Tax Credit, which is basically $1000 to use for your tax. If you owe tax, the $1000 will be applied to what you owe. If you owe nothing, the US Government will give you that $1000 in cash as part of your refund.

she deserves half, period. if y'all want to hash it out (and sounds like you all will) go to family court (no lawyer needed) and get a judgment of child support and a statement of who gets the tax return (it will be calculated into child support) I waited 9 years to get that done and lost a WHOLE lot of money by not going in sooner. go to court or just give her half and be done with it, it's just money, easy come easy go.
