yes you can claim them and yes (i'm pretty sure) you can file with no income and get the child tax credit. |

Without income you haven't paid into taxes so you aren't entitled to a refund.
Also, earned income credit requires that you have income in order to get anything - - so again, your situation indicates that you wouldn't get anything here either.
What I would want to know is how you supported 2 children and yet had no earnings. |

No income = No tax withhold and No eligibility for Refundable Credits = No Refund.
You can file a tax return but it wouldn't make much sense as you wouldn't receive anything. |

don't listen to those rumors,they're faker than a 3 dollar bill.
edit:anybody has the right to file a return,but when you file your return and you get to the part where it says federal taxes withheld put a big fat 0 there and then when they tell you your refund amount expect to see a big fat 0 there also then. |

Can I get money back? No, you didn't pay anything out -- how would you get anything BACK?
How would I do this? Just print off a 1040A and fill it out.
Added: You can file a return without income. It is called a zero-balance return and new immigrants often file these to establish residency. They are filed for various other reasons too. Perfectly legal.
It is NOT legal to let someone else claim the children unless that person is the childrens' parent and/or legal guardian and/or claiming the mother on their return as a dependent. |
