Company i work 4 just gone into liquidation ! how do i claim wages ? should have been paid today.?

I am afraid you will have to wait for the administrators to sort it out. They will manage the assets of the company as best they can, in order to get payment to everybody it owes. There isn't any guarantee you will get paid though I am afriad.

--- EDIT ---

Just to expand on this - there are no hard and fast rules or guarantees about what will happen to your wages, as it depends on what (if anything) the company has left to give anyone. As its gone into liquidation - possibly not a great deal.

There are likely a long line of people who will be queing up for money, including banks, suppliers, agents, the government and staff.

It will be the role of the administrators to sort out how much can be paid to who. There are legal procedures they have to go through, and a set order of who gets first pick.

It is probably best to let them contact you, and see what they can resolve from there. As I say though, there isn't any gurantee you will get your money - please don't rely on it. I am sorry.

You may be able to make a claim to the National Insurance fund. Check out the website.

Also where an employer gets in to financial difficulties, wages and salaries may not be paid. Employees may be “entitled” to earnings under of the terms of their employment contracts and are therefore treated as having “received” earnings under this rule. No tax charge arises for the employees they are entitled to a credit for the PAYE that should have been deducted. The employer-company is indebted to the employees for the unpaid wages/salaries. If the company goes into liquidation the employees are creditors of the company

Sorry to hear that I think you'll have to go through the company dealing with the liquidation and you might not get anything BUT you will be first in the queue

Are you in a union? If so your rep will be able to talk to your employer for you and that should be your first port of call.

If not a trip to citizens advice will probably be helpful and the advice is free.

depends where you live IE uk or USA.. if you have been with a company for 2 years in UK.. you can claim 1 weeks wages.. if not then they don't have pay u anything, and make sure you get holiday money, and you can sign on the doll straight way in the uk..

Bernie
I went through this last year, the company dealing with the liquidation will give you the forms to fill in to claim any money you're owed including Wages, Holiday Pay, Pay in lieu of notice & redundancy money. Once you send in your forms it takes abouth 3/4 weeks.

Edit... after sorting through my papers from last year.......

You will get something - ask the administrators for a form RP1, wages that are owed to you aren't dealt with by them, the money comes from the National Insurance funds, though it is limited to a maximum of ÂŁ310.00 per week.
See WWW.insolvency.gov.uk and request their booklet "Redundancy and Insolvency - A Guide For Employees"

My son was caught out with this. If you have not worked for them for 2 years + you will not get a penny - sorry. If you have been there over 2 years there is loads of paperwork you will have to fill out and then - just maybe - you will get a small percentage of your wage. Any assets sold off will go to paying all the people who are owe money, this includes suppliers as well as staff. I dont think you will get much, if anything.

dyno
You have to send your claim into the liquidator as a rule all employees are paid first, but dont expect the full amount.
