They must have obtained what is known as a 'garnishee order' from the Court. Such an order gives a creditor the right to obtain payment directly out of the debtors bank account.
Your partner will be able to establish the facts by contacting her bank, also, if necessary, the council itself.
You need to establish that due legal process has been complied with, and that the bank haven't released information regarding your bank account details, except in circumstances allowed by law.

although the council in this district didnt actually withdraw money from my bank account they got my partners bank account statement without without asking our permission. we actually went to the halifax and kicked up a dust. they grudgingly admitted when they had been asked and when they had divulged the information and that although they were only prepared to say that the practice is only 'semi' legal it happens several times each month at that particular branch.
maybe its just this particular council here in exeter that are trying to build a little empire for themselves or maybe its happening all over the country.
you will not find the local government ombudsman or your local councillor any help at all. your mp is likely to be more helpful.

I always thought no one had the right to withdraw money from your account without your permission except possibly only with a court order!!

If I was her I'd ask my bank for a copy of the signed approval to withdraw the money. If they can't produce it then surely its an issue she should take up with the bank too.

Did she give them her bank account number? but even if she did i don't think they can take it without her permission, you have to sign a direct debt slip first , I'd go down there and find out what's going on.

Get on to the bank play hell, close the account. The bank has no right to make any unauthorised payment, unless ordered to do so by a court.

Regardless of previous answers English/Welsh Councils cannot seize or remove money from bank accounts without permission - its not part of the Council Tax legislation . Only in Scotland does the council have powers to seize bank accounts.
You need to establish why the council contacted the bank and why the bank provided the details. Have the direct debit details already been supplied to the Council and they had merely checked the details with the bank ?
In any case without authority or notification then under the dd guarantee scheme you can reclaim the money through you bank.
I would suggest that you start by making an official complaint to your council and your councillor if your not happy about whats happened.

You have to legally pay your council tax, I think that they have a right to be able to take the money.
