Please Help!! I received a phone call today saying that council tax was owed on a flat my ex n I shared. I lived there for 3 months and moved out in September last year.He continued to live there until this year. He failed to tell me there was any money owed nad that debt recovery are involved! it was the first I heard of it today!I asked if they could split the bill as Ihave no contact with my ex and they have his address but they said they cannot do that as we r both liable so one of us has to pay and get the money off the other!I am a full time student and my only income is currently maternity pay off the government... is there anything I can do? |

IANAL. You should talk to the CAB about this one (as previously mentioned).
But, as far as I know, you *are* liable for any unpaid council tax while you lived there (or at least, while you were *registered* as living there).
You should have told the council when you moved out and therefore started paying council tax at/for you new accommodation. If you did this, and can prove it. You should be ok, but may still be liable for some of the debt (again, unless you can prove you've paid your share).
I also know that, when there are two named debtors, the council/courts/bailiffs can and do usually only pursue one of the named people (They dont wait to find both/all named people). Usually thats the easiest one to find. Unluckily in this case, it sounds like thats you. |

They can't take what you don't have.
Tell them that you can't find your ex and that you haven't seen him for a year and that you are willing to pay what you owe at £5 a month and that is the best that you can do.
Start paying them the money as soon as possible... they will want more but tell them that you can't afford anymore than that at the present time. As long as you make an effort to pay then they will leave you alone. |

I would go and see the Citizens' Advice Bureau and let them act on your behalf. Don't let the Council bully you. Repayments can be negotiated by the CAB. Good Luck |

If you can provide proof of your address from the time that you moved out, e.g. a utility bill or rent book for your new address, then take a copy to the council office and tell them that you are not liable for any council tax charges from Sept 2007. It was up to him to sort out the council tax when he lived there alone, he could have got a rebate for sole occupancy, if he didn't that's not your fault. Don't be bullied by the council staff, most of them don't know what they are talking about anyway. When you go there, be firm and don't ask them about the debt, tell them that you are not liable for any charges after the date that you left and to stop calling you. It is their responsibility to find your ex, and recover the debt, not yours, ok? Don't let them hassle you, they're just trying it on to get the debt off their balance sheet. |

Unfortunately, if your name was on the tenancy,and you failed to tell the landlord that you had moved out, then I'm afraid you are liable for the debt. Letters would have been sent to that address, so unless your boyfriend forwarded them to you, then you wouldn't know, however, the council would see it to be your responsibility to ensure that your mail was redirected or was picked up periodically. Council tax is a priority debt and must be paid. They have obviously been chasing him without success, so have shifted liability to you. Contact the council directly. You will have to do income and expenditure sheets to show what you can offer but you will need debt management assistance. Find your nearest CAB at the link below. |

I'd be careful that you actually owe the money, debt collectors don't get involved with council tax. Council tax debt is solely dealt with by the council and the court and if needed court approved bailiffs. The council will have sent you a letter within a few months of council tax being due if you or he hadn't paid. If you are registered for council tax at your new address or your new address is registered with your bank you would have received a letter from the council a long time ago instructing you to pay the debt, if you haven't received any letters from them i would be weary of paying any so called debt collectors anything until you have gone in and spoke to the council in person. The council don't ring people or get debt collectors involved they send letters, if they don't reply they send more and then finally they send a letter instructing you of bailiff action. If you owed the council for the council tax due while you lived there they would have tracked you down and you would have known about it by now. Contact the council, suppying evidence of the time that you lived therew and the time that you moved out, utility bill or bank statements will do and ask whether the money is owed and to whom it is owed to. Don't pay anything or give anyone who calls any details until you have spoken to the council in person. |
