anon | Council tax problem? |
i couldnt pay my council tax bills due to being in and out of work. they sent court summons and i wrote them an offer letter in which i said i would pay £75 every month.
i sent them this letter together with a cheque for £75 before the court summons and they ignored it and issued a liability order anyway why did they do this?
the account is with the bailiffs but was told to try the council.
they have ignored my letter yet cashed my cheque and simply sent a final demand letter for the whole amount before bailiff action with a form that says i must sign it and return it by law and give them my employment details .
the thing is i am unemployed so they cant take anything as im not working. i agreed to pay them back monthly as a friend can lend me money each month. why did they ignore my offer letter? what should i do? return form with a 2nd letter stating you cashed my cheque yet ignored me, i cannot afford to pay the whole amount and offer them monthly payment again?
help plz? |

Have you tried making an appointment to discuss it with somebody in person? Make sure they understand what you're trying to say and see that you genuinely want to sort the problem out. That would look more like you're cooperating with them rather than wanting things on your terms.
Another time make a deal with the council BEFORE they get to the point of sending court summons. |

get yourself alon to your nearest citizens advice beureu and they will be able to help you sort it out. they will also act as a go between for you, the council and the bailliffs. Good luck!!! |

They are not obliged to accept your offer but they usually do. They should have written to you and advised you why they have not allowed you to make a repayment arrangement, however they are not obliged to do this either.
Sounds like the letter they have sent is what we call a 14 day letter. It says, if you read the top, we will sent your debt to the bailiffs if you do not pay in 14 days, or do not contact us and make an arrangement to pay.
You are required to fill out the form they have sent requesting work or benefit details - they are looking for a way to collect the debt. If you put down your employers details, they will go for an attachment of earnings. If you put down benefits you are on, they will go for an attachment of benefits.
Bear in mind that if there is no repayment arrangement made AND there are no employers details AND no benefit details, they will have no other way to collect the debt, other then sending it to the bailiffs.
I would advise that you call them in the morning, advise that you have already sent in a payment of £75 along with a repayment proposal and ask that they set a SPA or SUMAR or whatever your council calls them (both stand for Summonsed Arrangement) at the rate of £75 a month.
I doubt they will decline this. I wouldn't. The council is not there to punish or harm you, they are the agency responsible for collecting your council tax, and any way whereby they will be able to collect it within a reasonable timeframe is a good thing for them. Recovery action is a last resort for non-payers. |

go to your local citzens advice bureau they should be able to help you, did you keep a copy of the letter you sent? take that along, or instead go to the council offices and speak to someone there, give them the offer and see what happens, but if i were you i'd go tou the citizens advice buraeu they are brilliant with this sort of thing. |

I have the same problem, send them back the letter they asked for otherwise if it goes to court which it willl if you dont pay the bailiffs or come to an arangement with the council, it looks bad against you. but the court will look in your favour that you offered and they ignored. I offered them money and they ignored me too, so i have been told just to hold out and wait till it goes in front of the judge. where you'll be able to say that you offered such and such but they ignored your attempts to pay the money back. the judge will make arrangements to have an amount suitable to be taken direct from any wages if you get a job or from any benefit you receive. My advise is not to talk to the bailiffs, dont let them in because as soon as you do that they can legally take stuff from your house. after failed attempts they will give the council back the debt where the council will either except an offer or send it to the court. either way dont offer what you cant afford, as soon as you get behind on payments they start with the bailiffs again! |

I know that it sounds like you are being reasonable about the council tax, but unfortunatly you cant decide what amount you will pay-it would be a nightmare if we all did that.
I understand your frustration as they ignored you, but took your money. You need to go to your citizens Advice Bureau, they will sort it out between the council and yourself.

They do not have to agree to your terms and any money you send them can be used to offset the debt.
If you have a genuine entitlement then you can claim benefit to cover this in future, but very unlikely to cover the bad debt. |
