By law the IRS can not disclose who may have claimed your children, that would be disclosing another taxpayers information to someone who is not entitled to that information.
You need to File a paper return and mail it in. You will both get notified that your daughters SSN was used twice, and you will be requested to submit proof that you were entitled to claim her on your return. Respond to this notice immediately. The IRS will determine who was qualified to claim her. If any refund was issued to the party who was deemed unqualified , they will owe the overpayment plus interest and penalties For more information call the Internal Revenue Service at 1-800-829-1040 |

As long as YOU are legally entitled to claim the child, you can and should do so. You can't and don't need to know if anyone else is trying to claim them. |

If you efile your return claiming your children and somebody else has already filed and claimed them, your efile will be rejected and you'll have to mail in your return.
If you and someone else claim the same child, the IRS will examine both returns and you'll both be asked to prove that you have the right to claim the child. Whoever doesn't will have to pay back the extra taxes, plus interest and possible penalties. |

You could call the IRS (1-800-829-1040) and let them know whatever you situation is. Most likely they will tell you to paper file your return (mail it in) which would take about 6-8 weeks for a response and once your tax return is in their hands they could match your children's social to who ever is claiming you children
But the IRS cannot tell you on the phone who is actually claiming your kids.
File your tax return and if it gets rejected the tax preparer should let you know why it got rejected.
Did you file your taxes and get rejected? That's basically the only way of knowing whether someone ALREADY used their social. |

Well I assume you have the usual suspects in mind as to who else may have claimed your kids, so you should just ask the usual suspects. |

nobody is eligible to claim your children but you if they always live with you .If you are married then your husband will claim all of you ,with him being the head of household. if you are divorced then both of you get to claim one. Best to check with your taxadvisor on this ! |

There's little information more protected than your tax returns. The IRS probably couldn't tell you directly.
But, if you file and claim your kids, and their social security numbers show up on someone else's return, their system should flag it.
Go to http://www.irs.gov find their phone number and give them a call. Plan on sitting on hold for a little while, but they are nice when you talk to them. Perhaps they can give you advice about how to protect yourself if someone else is falsely claiming your kids. You don't want to be the one getting audited. |
