Go read IRS publication 504.

Generally, no gain or loss is recognized on a transfer of [existing] property from you to (or in trust for the benefit of):

Your spouse, or

Your former spouse, but only if the transfer is incident to your divorce.

This rule applies even if the transfer was in exchange for cash, the release of marital rights, the assumption of liabilities, or other consideration.

Exceptions to nonrecognition rule. This rule does not apply in the following situations. Your spouse or former spouse is a nonresident alien. Certain transfers in trust, discussed later. Certain stock redemptions under a divorce or separation instrument, or a valid written agreement that are taxable under applicable tax law, as discussed in section 1.1041-2 of the regulations.

A property transfer is incident to your divorce if the transfer: Occurs within one year after the date your marriage ends, or Is related to the ending of your marriage.

As for part of their retirement it depends. Military pay is often considered a property settlement even though the money is received years later. As such, it's not alimony and the income tax stays with the serviceman.

If it is a division of the marital estate it is NOT taxable -- it was already yours in the first place.

If it is classified as spousal support it is taxalbe.

Lump sums generally are not classified as spousal support but are classified as a division of the marital estate.

A settlement is not taxable if it is for a division of property because it is not income. A portion of you ex's retirement income is all taxable as it would be if your ex got it.

I you get a lump sum of money in a divorce settlement it will be taxable. If you get a monthly check for you ex as part of the retirement that is also taxable. Uncle Sam is always there with his hand out.

Baby doll told you that you would not have to pay taxes on it until you told the Governement. That is wrong, because the government will know about it. Trust me!

Spousal Support is always taxable income, weather it is in a lump sum or a monthly payment. Sorry :(

No, as far as I know, it is not taxable. Although I do believe he can take it as a deduction on his taxes.
