Divorcing and trying to decide to file jointly or separately?
I am in the process of getting a divorce. I am a stay at home mom with no outside income. If I file as "married filing separately" will I get any income tax refund. It seems to me that I would be better off filing jointly and asking for my 1/2 of the refund in the divorce settlement. Or would I get 1/2 from filing separately?

If you file seperately, it is worse than filing single. You are not elgible for earned income credit. Also, if you file jointly, make sure that your name is on the check. As a rule it always is, but make sure. If both of your names are on it, he can't cash it alone and keep all of the money. Also, if you still have a joint checking acount, make sure he doesn't deposit it, and then pull all of the money out. Anytime you can file married, do so. Filing seperately really stinks.

You and the kids are a gold mine in a married, filing joint return so go that way if the divorce is not finalized by 12/31/08 and you are still legally married. Half of something is better than 100% of nothing.

If you filed separately, I don't see any way you can get a tax refund.

You may work it out with your soon-to-be ex for a joint return. He doesn't have to agree with it, however, it takes both parties to agree to a joint return.

Or you can work it out in your divorce settlement. The judge can require you two to file a joint return and split the refund in a way consistent with "fairness."

If you file separately, it would be just like if you were single. No income means you paid no taxes and you'd get no refund. If your husband is still being reasonable then you could ask for half of the refund from filing jointly but there's a good chance he'd take the money and hide it where the divorce settlement can't touch it.

If you have no income to report then you would be better off filing a joint return. Then you can ask him for something , I;m not sure if its half, if most of the income is his.

It depends on how much income he has to report and how old the children are.

If you had no income, then there is nothing to file separately. So your conclusion is correct.

Are you in a community property state or non community property state? How much of your husbands salary is community income? Darned if I know. The best thing all around it to cooperate and file a joint return. You can have direct deposit of any refund to up to three different bank account.

If you are still legally married on 12/31/08, you need to file jointly and try to get your husband to split it with you. If you file separately, you will get squat.
