Yes legally. |

No! You ONLY prepare Forms 1099 if you pay money to independent contractors in the course of your BUSINESS. You never prepare them for baby sitters or other folks who provide non-business related personal services for you.
Putting the provider's SSN or TIN on the Form 2441 ensures that the IRS is aware of the money. |

All u need to claim the payments are her EIN or SS#, full name, address and the receipts. Go to www.irs.gov and search forms for child care, the form is actually very simple. |

No. A babysitter is a household employee. You give her a W-2 and report Social Security tax on Form 1040 Schedule H after "grossing up" her wages so that the $7,000 is net. |

IF she worked at your house, you were supposed to give her a W-2. If she did the babysitting at her house (especially if she watched more children than your own), she was self-employed. |

Yes, anything over $600.00 requires a 1099
At $7000.00 she is more than the kid next door baby sitting once in a while while you have a night out. |
