Do I have to claim my husband on my tax return?
My husband drives a cab and doesn't pay taxes until the end of the year. We weren't married until July of 06" and I don't want to loose any of my refund because of him.

Your only choices for filing are "married filing separately", or " married filing jointly". Most times married filing jointly will give the better return. By the way, the date as far as being married is December 31.

If you were married on Dec 1 of 2006 then you have to either file married filing jointly or married filing separate. You should have waited to get married if you needed the return money so bad.

You do not claim your husband on your tax return, the 2 of you file a joint return, you are married. Tax wise, you are considered a unit, no choice in the matter. You have to determine, as a unit, how to handle the fact that you should have a refund and he would owe money.

You can file as Married Filing Separately and get your own refund but it will be smaller than filing as single which you cannot do. If you file jointly it will save you both money but since you are just concerned about yourself just file separately.

It'sjustme
You have only 2 choices, married filing jointly or married filing separately. 99 out of 100 times you want to file married filing jointly. Married filing separately cuts you out of many benefits and deductions. If I were you, I would file married filing jointly, then file an innocent spouse form 8857 which basically separates your return from his, so you are not penalized due to him.

You do not have to file a married filing jointly return, but if you itemize your deductions only one of you may take it and the other may not take the standard deductions.

You have to claim him because you were married for 6 months or more in 2006.
