Do I have to have my ex husband's social security number to file my taxes?
I went to H&R block and tried to do the online tax preparation, but I can't get by without his social security number. The problem is that I have no way to get his social. I don't talk to him anymore and we are in the process of a divorce. Does anyone know a way around this?

Don't file jointly.

However, if filing as "married" (filing separately), you still need to provide a SSN for cross-reference purposes.

If you are still married, then you need to get this information. Given that you are in the process of a divorce, you should simply have your lawyer contact his lawyer to exchange this information.

As much as we distrust our exes and as sensitive as SSN may be, you do need to provide it.

If you really cannot, you will be unable to file electronically. You will need to paper file and will need to indicate that the SSN is "unknown." A competent tax accountant (not someone at H&R Block that took a 5 hour training class) will know how to file the explanation. No a do-it-yourself job.

Did you ever file a joint return with him? If so you should be able to get a transcript from the IRS of that return, and it will have his social security number on it.

If you are not yet divorced, you need his SSN to file. Your divorce attorney should be able to get it for you. Or you can just get it off your copy of an old tax return.

By the way, since you're still married, he's not your "ex" yet.

If you filed jointly in the past, you can contact the IRS and get a tax transcript for free that will have his SSN on it.

If you were married on 12/31/2006, you HAVE to file as married. Look on a prior tax return. His TIN will be there.

Don't go to H&R Block since they are expensive and incompitent since they hire people that flunk the final, in my opinion.

BTW, don't listen to "Spot" or "Michaelsm..." or "Jaybo" -- they are wrong! You HAVE to file as married becasue you are still married.

No its illegal to file jointly after even a legal seperation much less a divorce.

Sure, file "Married-filing Separately" or if you live alone w/children you can probably file "Head of Household" (providing you qualify)

If he is your ex-husband you should be filing as unmarried. There would be no reason to need his social if you are filing a seperate return.
