Tax returns are cash-basis. That means the IRS only cares, specifically, about what you actually spent and made in a current year. So if you pay your property taxes in 2009, that's when you can deduct them- on your 2009 tax return.
A lot of people fudge on this, though, regardless of what they should and shouldn't actually be doing. |

You must pay them in 2008 to take the deduction on your 2008 return. If you don't pay them until 2009 you'll have to wait until 2010 to take the deduction. |

Assuming you are talking about your own personal tax return, you take the deduction in the year that the taxes are paid. |

If you pay the taxes in 2008, you get the deduction in 2008. |

David Z. is wrong. You can't deduct tax escrow paid to lender. That is still your money until it is paid to the taxing authority. There are circumstances where you might put money in escrow, but no taxes will ever be paid.
As an example, we closed on 9/1/1972 on a new house. We made 4 payments including escrow that year. Because of when the subdividing of the property was recorded, there were minimal taxes due for the year, and the builder paid them. If we had sold 12/31/1972, our escrow would never have been used for taxes. |

You get the deduction in year you pay them.
If you escrow them with your lender then you can count them as paid when you pay them to lender. It would not matter when your lender paid your tax bill. |
