Do I have to pay delinquent taxes by previous owner?
I recently bought a bank-owned foreclosure house in San Jose, CA. And, today, I got a mail from Santa Clara county regarding the delinquent taxes by previous home owner. Do I have to pay for that? In the "Assessee" field, it shows the name of the previous home owner (not the bank's name).

It doesn't make sense. I wasn't the one who own the house last year and why do I have to pay for that? And, my Realtor (the buy agent) did not mention anything about this kind of tax and it is a surprise for me. Can you give me any advice please?

now, if the tax collector generated a supplemental tax bill for an earlier period after you took possession of the house then it can be understood, but you still would not be liable for the tax. how could you? you did not benefit from those taxes.

You need to contact the closing attorney right away and tell them about this.

You do not owe the delinquent property taxes by previous owner. You should turn the bill over to the bank. When the bank foreclosed, the bank should have be aware of the delinquent taxes. I'm surprised that the title of the house got transferred without any mention of the delinquent property taxes. It's not your problem but the bank's since they became the new owner of the house you purchased from.
It might be prudent that you write a letter to the country assessor's office with a copy of the delinquent bill attached explaining about the facts and that you had turned the bill over to the bank.

Don't worry. If you used a Realtor you probably had a traditional closing with "TITLE INSURANCE". Title insurance covers just your type of situation. It insures that you received title to that house free and clear plus whatever loans you may have taken out to purchase the home. Call your title insurance company right away tomorrow.

Ordinarily payment of all property taxes by the seller is a standard condition in sales contracts and back taxes would turn up in a title report. If that is the case from your sale, you should contact your escriow company and demand they pay the bill because the title insurance will gurantee it. If you have agreed to pay the taxes then pay up. Regardless of what any other posters state, the property is reponsible for the taxes and if the property owner--that's you--doesn't pay it, the tax collector call sell it for you.

You need to contact whomever closed the purchase transaction. The bank should have been required to pay those taxes in closing unless your contract specifically put the onus on you.

Call your agent right away. If you get a run-around, ask to speak to the broker.

Go back and look at your settlement documents as well as your purchase contract. Somebody dropped the ball.

yes you are now responsible for all debts on that property and if you do not pay them the county you live in can forclose on you but most counties will work with you on this type of thing and may set up a payment plan

Do you still have a copy of your purchase agreement? It should be in that document somewhere about what taxes would be taken care of; your realtor should have told you about delinquent taxes if he was representing your best interests. - and trinket is right that you are responsible now as owner
