Do I owe the IRS for a mistake tax preparer made? ?

From the point of view of the IRS you are the one responsible for the return regardless of who prepared it. Most tax preparation firms will pay at least the penalty and interest if they made a mistake. So will pay the tax also. The issue is if they are the ones that made the mistake. If they had the correct information and did not enter it into the return that would be their mistake. If they did not have the information and there is no reasonable way that they should have known the error is on you. Generally EIC payments are clearly reported on a W-2 form, if they had that form and it is on the form it would appear that the mistake is theirs.

Any reputable and competent tax professional should have known about the advanced EIC payments. they show up on the W-2.

That being said, the tax payer is ultimately responsible for all items on the tax return. Any additional tax would normally be the responsibility for the tax payer because that is tax yu would have owed if there had been no error.

Interest and penalty are also your responsibility, although many preparers will pay interest and penalties, they are not required to.

You can always sue the preparer, but you may only get the interest and penalties.

To answer your question, yes if the preparer made a mistake, you are still legally responsible for it, and if the mistake caused you to owe the IRS, then you are the one who owes them.

Are you saying you got Advanced EIC payments and didn't report them? Then you got paid EIC twice, once in your paychecks and then again when you filed, so of course you have to pay back what you got but shouldn't have. The Advanced EIC would have shown on the W-2, so it does sound like it was their mistake. But you are the one who got paid money you didn't have coming, so you have to pay that back. You probably won't get hit for penalties and interest though, under the circumstances.

The preparer might pay the penalties and interest, although they aren't legally obligated to, but you are the one who has to pay back the money you got but shouldn't have. Why would they have to pay that? YOU got the money twice, so have to pay back what you shouldn't have gotten.

Did the preparer know you received EIC payments? If not then it is your fault for not informing them. In the long run it is your signature that goes on the form and you are responsible. If it is HR Block they have some guarantees on accuracy if you informed them and it was truly the preparers fault.

i work in an accountants office and let me tell you something....the IRS can be a pain. unfortunately alot of it comes down to one question. 1 did your preparer know that you had recieved EIC payments? that would be the first part. 2 did you recieve money back that you should not have? most of the time if the preparer made a mistake you are still responsible for the amount that you recieved due to their error but the IRS will be willing to let the fines and interest drop.

If they would not have made the mistake you would have paid it on the correct original return so the only thing you are out is the interest and penalties if any, That would be the only thing you could expect to get out of the preparer since that is your only real damage.

Didn't report EIC payments? What does this mean? If you failed to report advance earned income credit you would owe it but that is something that should show up on your W-2s

Um, I think it depends on the contract you signed (if any) and whether or not they offered some kind of guarantee. Unfortunately, unless they said in writing beforehand that they would take responsibility for mistakes, I think its your responsibility.

Even if they had a guarantee, there is likely a clause that indicates that it has to be their mistake, and not your failure to disclose info that they will pay for.

Ultimately, you are responsible for what's on your return, not the tax preparer, and you certainly can't hold them responsible for something you may have neglected to report to them.

sue the tax preparer. Its their job, that you payed them to do. They didn't do that job. So sue.

Yes. But you can also 'settle' your debt with them for a lot less then you owe, it's not hard.
