well you don't have to charge the customers but the government is going to come looking for that money, the TAX from the goods BOUGHT in your store, so you either charge them or you could pay it yourself (not a very popular option) |

I don't know the rules in TX but in NY you have apply for a special sales tax ID# & authorization to collect and remit the sales tax from customers.
Using that special ID# you also obtain a resale certificate allowing you to buy the goods you sell without paying sales tax upfront. Instead your customers pay the tax and you submit amount collected (or should have been collected) to the state tax dept. Until you get the special ID# and/or authorization you cannot charge your customers sales tax |

You need to get a tax id from your state. You'll charge sales tax to your customers and remit it to the state, but won't pay it yourself on items you buy for resale. |

You really NEED to look up the requirements for a business license in your city, county, and state.
The laws vary, but for example, her in AZ, I had my own small business. I HAD to get a business license per my city, and since I resold hardware, I HAD to collect sales tax at the city an county rates (7.5%). Most services here are NOT taxed (like labor in building a computer sytem, etc) but in some places, labor, like lawn care is taxable. IN any case you pass the tax on to the customer.
So if I bought a product from another store, and RESOLD, as a business, you have to collect sales tax and submit it to the state under your sales tax ID. I had to do it quarterly, so the money I would collect in sales taxes I would then write a check, along with my figures of what I paid taxes on, to the Arizona Department of Revenue. They in turn distribute the sales taxes back to the counties and cities.
This is the correct, proper, and legal way to operate business.
The advantage of obtaining a reseller ID, or sales tax ID and business license is that you CAN purchase goods from say, SAM'S club, or other manufacturers, resellers, or vendors and NOT PAY sales tax on your purchases since you are buying to RESELL the items. However, if you consistently buy stuff for your own personal use, without paying sales tax (ie you lie and say it is for resale when it is not) you are violating the law and can have your license revoked.
Stay above board and legal. That way a 'miffed' customer can't 'turn you in' to the department of revenue. |
