If you live in a state that has a sales tax AND you purchase something from a business that has a physical presence in your state, then that business MUST collect sales taxes based upon where the item is shipped.
What most people don't know is that if you live in a state that has sales/use taxes and you purchase something from a company that does NOT have a physical presence in your state, it is YOUR responsibility to pay the sales taxes to the state. States don't usually enforce this except on businesses, which is the reason most people don't know it.
Whenever you hear about Congress extending the ban on online sales taxes, that refers to something a little different from the situation above. Some people want businesses that sell over the Internet to collect sales taxes on ALL transactions regardless of whether the business has a presence in a particular state or not. For example, assume a person who lives in Florida, buys something from an Internet retailer whose only physical location is in Texas. In the current situation, the retailer would not have to collect Florida sales taxes. However, if the Internet sales tax ban were lifted and States decided to enforce the issue, that Texas retailer would have to collect Florida sales tax and submit it to the state. Considering many states have sales taxes and each of those allows the individual counties and cities to include an additional sales tax, a small business would find keeping up with the different sales tax amounts difficult. |

If you live in a state where Amazon has a nexus, they are required to collect your State's sales tax. Amazon has a major distribution center in KS so they collect KS sales taxes on all orders shipped to KS. They have no nexus in MO, so they don't collect sales taxes on shipments to MO. |

So far, online retailers have not been required to collect sales taxes for states they have no presence in. NY State is trying to impose this and Amazon is fighting it. In most states, you are required to report your purchases from out of state retailers for which no sales tax was collected on your state income tax forms and to pay the sales tax along with your income tax. Most people are ignoring this. |

It depends on what state you are in, and what state the selling company is in.
Sales tax is a state tax. Different states have made agreements with each other to collect for each other. Amazon itself is in Washington State, but many items are offered by other sellers in other states.

1. If you buy something from a website of a company that operates in your state (this mostly applies to businesses that also have brick-and-mortar stores), they charge sales tax.
2. If you buy something from a company in another state (whether you go to that state, you order online, your order by telephone, or you order buy mail) and either you are not charged sales tax or you are charged less sales tax than you would have been charged for the same purchase in your home state, then you are supposed to send your home state a check for a "use tax" equal to the amount that you saved in sales tax. |
