Does anyone have to claim my 15 year old daughters income?
My 15 year old daughter made $1100 last year in babysitting money. As a part of my divorce agreement I can claim the earned income credit for her, but my ex claims her as a dependent. Who, if anyone has to claim that she made this money or does only she have to? Does she even have to?

I am sure it was paid in cash. There is no sense in even reporting it. I am not advocating dishonesty but the amount is too small to report on your or your husbands return as neither you or he made the money. In addition, it was less than $1,200.00

First of all didn't make more than 3500 which is what one needs to make to file taxes. And second of all it doesn't matter since she is a minor she doesn't pay fed tax on it.

your daughter can claim it herself or you or your ex husband can claim it, but she is better to claim it herself

Your daughter is only 15 and did not make more than $5500, so she doesn't have to file taxes like some people say. I believe that the setup you and your ex have should work out okay for the government...if not, they'll let you know. But you should be fine. If she files under self-employed, it is possible that the government will want her to pay taxes on the money she makes. My mom has two jobs...one self-employed from home and the other in an office (she is a medical transcriptionist). When she files taxes, the government takes a cut of her tax return to cover the federal income taxes that weren't taken out from her self-employed job.

Your daughter has to claim it as self employment income. She will file a Schedule C and will owe self employment tax and federal tax if she doesn't have any deductions on the Schedule C. If you have state tax where you live she may also owe state tax.

I don't think she has to claim anything unless she makes X amount of money for the year. I remember in high school my sister worked for Taco Bueno and she made less than whatever the minimum amount is for you to file. She didn't get into trouble. You just need to talk with someone about it. Good luck!!

Legally yes she has to since it's over $400. She would file her own return and claim it.
