Full guides on how to claim your bank charges back are on my site below.

However, all bank charge claims are currently on holding pending the results of a test case being brought to the High Court by the OFT (Office of Fair Trading), to decide once and for if bank charges are unlawful.

The case is scheduled to start at the end of January 2008, and is expected to run for at least a year before the final binding judgement is reached. If the OFT win it will make it much quicker and easier for everyone to claim back their bank charges. If the banks win though it will mean an end to bank charge claims.

In the meantime the banks have been granted a hold on dealing with claims, until the result of the case is announced.

If you want to claim, you should still put in your claim now, as it means that if the OFT win you can claim back 6 years from the current date, rather than the date the claims resume, giving you another years worth of charges.

To claim now, all you need to do is to write the bank a letter asking for your charges back (templates on my site below). Send this to the banks head officer (addresses on my site) by recorded delivery. The banks have to log and acknowledge your claim within 5 days, and it will then be put on hold.

If the OFT win the case, your claim will resume and should be dealt with quickly as its already in the system.

write to them & ask, but beware all banks & bs have put a hold on this untill a test case results come through, it could take up to a year.

luckily for me I got mine back just b4 the test.

Banks make charges. If these are reasonable for the work they have done for you and the bank has previously given you a list of charges, you do not have a case for claiming them back.

Some banks make penalty charges: for example if you are late making the minimum payment on a credit card or have an unauthorised overdraft. These need to be reasonable and you can ask for a refund if the amount charged is higher than the cost to the bank of dealing with the problem. What constitutes a reasonable charge in these circumstances is currently the subject of a court case.

If you feel you have been unfairly treated, write to the bank with full details heading your letter COMPLAINT. This will trigger the bank's complaints procedure. If you and the bank cannot reach an agreement, your complaint can be referred to the independent Financial Ombudsman Bureau - but you'll have to join the queue.

Just calculate the charges over a period of time.Have you kept your statements for a few years? With the information to hand, write to Halifax Head Office quoting the charges you have paid and request a refund.

Halifax is a bank not a building society. Thats why I keep my b/s account with Britannia cos they dont charge ever.

Your first step should be to write to Halifax at their registered office.

There are quite a few websites that give advice on this subject (see sources).

As Halifax is one of the organisations that have applied for a test case in court, you will probably have to wait for the outcome of that but it is still worth getting your claim in now.
