Does my babysitter needs my son's SS??
I give my son's aunt $ weekly for watching my son while I work. She says she wants to file taxes for the $ I have paid her but I never deducted taxes because we agreed it was just something to keep her busy while her own child was at school. Anyhow, how can she file taxes if she doesnt get any taxes withheld? I didnt plan and didnt put down any deduction for child card on my taxes. I also found out from my son's father that she is not a citizen in the US (I believe she has a green card) and she told him that H & R Block told her in order for her to claim the few hundred $ I gave her, she needs my son's SS#. I think she is lying and I am not giving my son's SS out but I am confused about the whole situation. Any advice would be greatly appreciated.

Thank you. I asked my own tax person and she said his aunt doesnt need it but I thought MAYBE since she claims she asks the people at H & R Block that they know something my tax person doesnt. It's sad cause even though she isnt my family, she is my son's family but I didnt think people can be so sneaky. Luckily I have my important papers hidden cause I'm sure she snoops around my house when I am at work. I have no one else unfortunately to watch him but I am taking a medical leave in 2 weeks so at least I wont have to deal with her anymore after that.

No, she would not need your son's ss# to file taxes on what you pay her for child care. If you claim a child care credit on your return, you would need HERS though.

She can, and is actually required to, file a tax return reporting what she's paid for babysitting, but wouldn't need your son's sss# to do so.

There's another problem here though. If she is babysitting at YOUR house as your question implies, and not at hers, then you should be treating her as a household employee, withholding taxes from her pay and paying the employer taxes due for her wages.

It's possible that an H&R Block employee did tell her that, but if one did, they were wrong and are incompetent to be preparing taxes.

She might be trying to use it for other reasons. If she needed a SS# for taxes it would be YOURS since you are her employer not your son.

She doesn't need your son's SS# for this purpose, she is lying.

I can't understand why, but if she really wants to file taxes without a social security number than she can file annimously. I dont know the process since I am a U.S. citizen but I know it can be done and it definately should not require knowing your son's social security number.

This has bad new written all over it, you may want to think long and hard about continuing to allow her to watch your son.

If she were a daycare, then possibly yes, but she's just a sitter, she does not need that. Fire her, find someone else.

Be wary of this. What is she going to claim? Does she plan to pay taxes on the babysitting money? Not likely. It should be you wanting her SSN to watch your child, not the other way around.

You could find your child's credit ruined before he's of working age...and his SSA benefits squandered by an illegal. Be careful.

She does not need you or your's son ss to pay taxes on the money you paid her.

You would need her ss# to claim the dependent care credit for the money you paid her.

She does not need his SS # or yours. However, if you want to claim the child care costs, you do need hers. Be very careful about this. There are identity theft scams that start with just a SS #.

NO. Don't give her your son's SS.
She doesn't need it to report earned income, only if she's claiming him as a dependent. Don't give it out at all!
Now you need her SS if you're deducting the child care payments to her and getting the child and dependent care credit.
She can file taxes as self-employed and then she pays self-employment taxes on her earnings.
