Does separated count as single when filing taxes?
My soon to be ex husband and I have been separated for about a year and 1/2. Can I file single on my tax return or do I need to file married filing separatly? Last year we filed jointly.

If you were considered unmarried by the end of the year and you took care of at least half of the living expenses for you and a dependent, you should be able to file as head of household, which kicks the crap out of filing single or married filing separately. Check it out on irs.gov to verify what I've told you, but if I were you I'd try to file head of household (less tax yay!!).

If you were not yet divorced at midnight on the 31st of December you have only two choices for filing; married, filing joint; or, married, filing seperate. If you have any children, did not live together under the same roof during the last six months of 2007, and meet the support and other tests; then you could file as head of household; your soon-to-be-ex would file as married, filing seperate.

if you are divorced then file single, if not you have to file married filing seperatly, make sure you guys have the same things down on your tax returns if you are MFS, or you'll get audited

I'm pretty sure you have to file married filing seperately.....but i'm not 100%. Go to irs.gov
Maybe they will have some answers!

I am NOT an expert, but I would think that if you are still legally married, you would have to say "married" until the divorce is final. Again, I don't really know, I'm just assuming. Good luck.

If you live in a state that has something called a legal separation, with formal court papers, then you could file as single. But if by "separated" you just mean you are living apart, even if you've already filed for divorce, no you have to file as married filing separately or else file a joint return.
