Legally she is required to pay taxes on the income whether you claim the child care credit or not. But yes, if you claim it, you'll have to put her identifying info on your return and it will be cross-checked against her return.

Hey bean - how do you pay a babysitter/child care provider in a form other than cash? you mean pay by check only? payment is payment - it doesn't matter how it's paid

you can use childcare expenses as a deduction only if your babysitter was paid in a form other than cash and has provided you with a tax id# or SS# - and yes they will have to claim it as income and pay taxes if you claim it as a deduction

Thats under the table and the government has no idea that you had her babysit for money. If you show them receipts then she will have to pay taxes. Save yourself and your babysitter the trouble and money and just keep it on the DL. The IRS already rips everybody off enough so why give them even more?

It doesn't matter whether you get the receipts or not. She legally is required to pay taxes on her income just like everyone else.

well, you should have been withholding taxes too, so not only would she be required to file her taxes on that income - you should be too.

I am not sure but she is suppose to be doing 1099 unless it's hush hush. If the receipt it from a company then maybe but if it a receipt book that you buy at walmart I dont think it really matters.
