I don't think that Virginia recognizes common law marriages, only Alabama, Colorado, Iowa, Kansas, Montana, New Hampshire (posthumously), Oklahoma, Rhode Island, South Carolina, Texas, and Utah.
Here's what the IRS says in Publication 17:
If you are considered married for the whole year, you and your spouse can file a joint return, or you can file separate returns.
You are considered married for the whole year if on the last day of your tax year you and your spouse meet any one of the following tests.
1. You are married and living together as husband and wife.
2. You are living together in a common law marriage that is recognized in the state where you now live or in the state where the common law marriage began.
3. You are married and living apart, but not legally separated under a decree of divorce or separate maintenance.
4. You are separated under an interlocutory (not final) decree of divorce. For purposes of filing a joint return, you are not considered divorced.
So, it looks like (1) if the state that you live in recognizes common law marriages and (2) you were in that circumstance on the last day of the year then, the answer would appear to be yes.
But, you don't meet the conditions so, your answer is "No." |

Find out IF VA is a common law state...and that will determine whether u can or not. I am from NC and it is not...so it doesn't matter how long you live together u are not considered married....tgod or I would have had to split my property with my ex partner of 20 years...but I checked that out b4 I purchased my home....better to know than to get burned in the end....... |

Legally, you cannot file a joint federal return unless you were legally married at the end of the tax year.
California allows registered domestic partners to file a joint state return. Not sure about VA.
Living together unmarried affects ability to claim "head of household" on a return filed by one person and affects whether or not one of you can claim the other, but does not affect ability to file jointly.
In some states, but not all, living together affects whether a "common law" marriage exists. If a "common law marriage" exists under state law, then you are husband and wife, not fiances, for both federal and state tax purposes.
Being engaged has no tax implications. |

I don't think so...the USA does not recognize gay marriage. Therefore, you are technically single as far as taxes go. |

I did not think that you could, but years ago when my now husband lived with his girlfriend, she had two kids and they had one togther, he has a tax filing where an actual preparer did them and they filed with him head of household, all the kids and her listed as dependents. I still think that was wrong, as she was a single person, having nothing to do with him legally, just as you two are just single filers. That's the key word "you're not married", so you would be each filing single seperately. |
