If you meet the income requirements for earned income credit, then the answer is yes.

I have attached a link to info on the earned income credit.

You would be able to use the baby as a qualifying person for EIC - there are other rules you must meet also, mainly income limits. The rules are the same for all states on your federal return.

Try these phone numbers for an answer

If the baby is born before we reach 2008, then you child would be a qualifying child for the whole year and if you meet the other requirements, yes, your baby would count for EIC purposes.

wartz
Yes, if your income qualifies

taxpf
You do not have to have a child to qualify for the Earned Income Credit.

Call IRS. I would think you could write the baby off as another dependant though.

As far as I know its the same nation wide, since EIC is federal. Yes, if your baby is born before Dec.-you'll qualify for the EIC....keep in mind, if you make too much money and don't have enough with held from your payroll each check, you may not get anything back for the EIC. To help prevent this, try claiming 0. This will ensure a good return.
