It says the child must live with you for 6 months, but on Dec 31st of this year my child will be a little over 5 months. Do you think i could still get the earned income credit, has anyone tried this, when the child wasnt 6 months old exactly? |

A child born in the last half of the year qualifies the same as one you had all year. The six month rule does not apply to newborns.
And yes, IRS can tell the age of the child from Social Security information. |

The IRS knows how old your baby was - the birthdate is associated with their ss# which you have to provide. But read the rest of the instructions. If the baby was born that year and lived with you for whatever time they were alive not counting time in the hospital, they are a qualifying child as far as living with you goes. They don't have to meet the 6 months. |

A child who is born (or dies) during the tax year is treated as having lived in your home for the ENTIRE year. In the box where it asks how long your child lived in your home, put 12 months. |

The 6 month thing is for babies over 6 months. Essentially the year a child is born it is considered to live with you for the entire year. |

Well yes because the actual law states more along the lines of that they live in your household more than 6 months and that they have to be in you household more than 50% of the time. Not to mention that the social security number allows them to see the age! I know it sucks because our baby will only be like 4 month at tax season so we cant claim until next year! Good luck though! |

In order to claim EIC, you must provide the Social Security number of the child on the tax return. Guess where the birthdate of the child is registered. Do NOT do it. If you are caught falsely claiming EIC, the ability to claim in the future is severely hampered. |

Yes, the IRS can tell how old your baby is. When your child was born, a ssn was applied for. |
