Economic stimulus check question. Who's right?
I was talking to a family member about the economic stimulus checks being sent out by the IRS. The family member said that not only has she not filed her taxes for 2007, but she is just now working on taxes from 2006. Her husband started a small company and they didn't file on time due to "not wanting to pay so much", but as I explained to her, now, they will be paying even more. However, she said that once she finishes 2006's taxes, followed by 07's, that she was told that she would still get the economic stimulus rebate. We argued a bit about it, and I've done *some* research and saw that certain people fitting certain circumstances can still get one without filing their 07 taxes, but her and her husband fall under none of these. Is there any way that they will be getting one back? She insists on arguing with me, when I read that your taxes had to be done ON TIME to get the rebate. Thanks for any help

If her taxes were not filed (and processed) by April 15, her rebate is delayed.
If she had filed for an extension, her rebate is deferred until all returns are filed.
If she owes money as well, her rebate will be reduced by what she would get in her refund, so she still might not get the refund.
SHe has a lot of variables that go against her getting a rebate, so she should not expect one at this point based on the expected distribution dates listed.

If she doesn't file a return for 2007, she won't get a stimulus payment. If she just hasn't filed it yet, but does by October 15, 2008 and she qualifies, she'll get it. They don't have to be done on time. They have to be done on time to get it on the currently published schedule, but if they file for 2007 by 10/15/08 they'll still get it, just late.

she will get penalized and will have to pay for not filing on time,she will be eligible to get her stimulus payment on her 2008 taxes{next year}..too late this year

This is from the Frequently Asked Questions section about the Economic Stimulus Payment at www.irs.gov.

"Q. I have not yet filed my 2007 tax return. Can I still qualify for a Stimulus Payment in 2008?

A. Yes, but you must file a 2007 tax return. The IRS encourages you to file a return even if your income is low or much of your income is tax-free. File your return, if possible, by the regular April 15 deadline. If you file after April 15, with or without a tax-filing extension, your payment will be delayed. If you qualify for a payment, you can insure that you get it by filing your return by Oct. 15, 2008.

Q. I owe some money on my 2007 tax return but the amount I owe is less than my expected Stimulus Payment. Can I wait to pay the balance due and simply let my Stimulus Payment cover it?

A. You should file your 2007 return and pay the entire balance due by April 15. You should not wait for your economic Stimulus Payment to offset the balance due. If you wait, penalties and interest will accrue between April 15 and the date the balance is paid, even if it is ultimately covered by the Stimulus Payment."

So it seems the tax return does not have to be done"on time" but it does have to be filed before the payment will be made.

The answer to your main question is NO she cannot get a rebate check without filing an 07 return...period. What it says is people who normally do not have to file a return must file a return for 07 to get a rebate...

Second...if she owes money to the government they will take her rebate check and apply it to what she owes...so she is unlikely to get one anyway...here are quotes from the IRS website backing this up:

. What do I need to do to get an economic stimulus payment?

A. All you need to do is file a federal income tax return for 2007. Even if you are not otherwise required to file a tax return, you must file a 2007 return in order to receive a payment this year. Although some filers, such as high-income filers, will not qualify for a stimulus payment, most will.

In most cases, you will fill out your return, reporting all your income, deductions and credits as you normally would. But even if you are not required to file, you must file a 2007 return to get a stimulus payment this year. Low-income workers, Social Security beneficiaries, certain railroad retirees and those who receive certain benefits from the Department of Veterans Affairs who normally don’t file may receive a stimulus payment if they do. The IRS will provide special filing instructions for those who do not otherwise have a filing requirement. The instructions will explain which lines on the tax return the filers need to complete.

Q. I'm eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

A. Yes. For this purpose, the Stimulus Payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support.

Q. How will I be notified if my stimulus payment was used to offset an outstanding debt?

A. If this occurs, you will receive a letter explaining how the Stimulus Payment was applied.


So my gut tells me that either way your friend will not get a rebate...have her check out my source if she wishes (ie doesn't believe you).
