Employer JUST gave us the 1099 on April 3rd....can I turn him into the IRS?
My husband was just given his 1099, we had been asking for it since the middle of Feb. from the employer. Then when we got it there was 10K more reported than actually earn wages earned........the employer is currently fixing this "mistake". Can I still report him because he was so late in giving us the 1099, he didn't mail it either he placed it in our mailboxes...

more detail....employer has filed a corrected 1099 for 9K less than orginally stated...employer and I went line item by line item of each pay check recieved....

Husband should have been classified as W2 however you have to choose your battles and employer is providing a check to cover part of fica....

all income tax forms have to be sent out before the end of january. you can report him for not giving you the 1099 till now.

AND he cant put something in your home mailbox like that. its against the law

Yes you can report him - he missed the deadline by a lot! That doesn't change your responsibility though to file and pay your taxes on time.

Either file an extension (and pay the taxes you owe) now, and file an accurate return later, or go ahead and file an accurate return now. But don't file a return showing more income than you had, if you KNOW (key word there) that the higher number is incorrect.

Also, you're question focuses more on what you can do to the "employer" than what to do about your tax situation. Is he really an "employer"? Why did he issue a 1099 instead of properly withholding taxes and issuing a W2?

Getting classified as an employee can save you half the S/E taxes. Would also ruffle some feathers at the "employer".

Sure, you can report him. I doubt it will do any good. I wouldn't worry about that, though. It sounds like your husband's employer is pretty lax when it comes to paper work and not very accurate. What you need to do is preserve all pay slips and all evidence of what you were paid last year. You will need it when the IRS discovers a discrepancy between what your employer reports and what you actually earned. If your employer makes an amended report to the IRS with the correct wages it will help, but I wouldn't count on it. It's CYA time.

I'd be complaining big time!!
IRS will still look at the 1099 you did receive and compare that to what you report on your return. Don't let the incorrect 1099 stop you from filing on time and being penalized. You can amend your return later whenever he gets the corrected 1099 to you.

You can report him, but the IRS will already know he is late if he is just now filing. If he did file by the deadline he will now have to file a corrected 1099. The employer could be subject to a small penalty if he does not file a 1099 or is late filing it, but you are still required to file a tax return with the proper figures on it. If the person you are working for has filed the 1099 and now files a corrected one all will be well as long as the figures you report are the same as his. Filing corrected 1099's is actually quit a common occurrence. The most important thing is for you to file an accurate tax return, and be able to back up your numbers

Sure you can report him, but you might get fired.
Just file your taxes correctly, and start looking for a new job. This "employer" is either incompetent or corrupt, or both. Get away from him.

There is a place where you will file a complaint about him but if you know of anyone else that had the same issue as your husband is best to have them file to the more complaints the better.

seems your employer is a lil un organized and wants to be able to write off an additional 10k for his own taxes...lol ... if i was you call the irs and request an extension, and explain that you are self contractors and have not got a corrected 1099 yet.
