Olivia | Employer won't send my W2's? |
I left my last job which I was at for 7 years, I moved, and my employer won't send me my W2's. I am still in contact with a girl who works there still, as a friend & I gave her my address to give to him, and she said that she got her W2 and that I should get mine soon. So I asked her to remind him to mail mine, and he claims he lost the address. SO I had her give it to him again..I still haven't gotten the w2. Is there any legal action that can be taken against him without me having to hire a lawyer and cost me money because I can't afford a lawyer. I know him, and he is the type to play games and try to screw employees over so I don't have a lot of faith that he will actually mail my W2. |

Your employer or former employer has until Jan 31st to mail the w2's, by law. If it is not sent to you by then then you can file a w2 complaint directly with the IRS for free. |

he is legally required to at least postmark that w2 by the 31 of jan.
if you cannot obtain a w2 than sometime near the end of feb, unless they changed it, than you can file your taxes with your last check stub providing you prove to the government that you tried everything you could do to get your w2.
i do taxes. i just cant remember the exact date you can file using your check stub. just remember you must try your hardest to get your w2. |

If you don't receive it shortly after 12/31, you can complete a substitute W-2:

You include a reason as to why you do not have a W-2, so you could report what happened.
I'm guessing this a small employer who does not use online paystubs/W-2's. Does your employer use a payroll service? Or an accountant to do paychecks & payroll tax forms? If so, you could try to contact them directly to ask for a copy to be mailed to you at the address they have on record for you (might be a small cost). |

By law he has until January 31st to mail out your W2. If that date comes and goes, you contact your State's Workforce Commission or Attorney General's office. They can direct you to the correct department that will contact him. Try to fax over your address or email your address to him with a carbon copy to yourself, so you have proof if he denies ever receiving it.

I got all of my w2's on line @ w2express.com
all you have to have is your company name and a pin number. (which they give you a number to reset your pin if you dont have it)

Employers actually have until January 31st to mail out the W-2's so there is nothing you can really do now any ways.
If you don't receive it by Mid-February you can fill out an Alternate W-2 form where you can state why you did not get it. In this case there is nothing you could go after him for, but the IRS would contact him.
Can you trust your friend at this place to get your W2 and mail it to you on her own? |

Well first off i'd speak with your boss directly, the "heard through the grapevine" thing could give him some huge leway if you ever did decide to take this to court. The best thing to do would be to type a letter to your boss include your new address and fax or mail it to him and keep the fax transmittal sheet or certified mail receipt, this will back up the validity of your claim that you did supply the address to him.
Also, you're going to have to wait until atleast mid February before taking any legal action, employers are able to mail them out up to Jan 31st.
I hope it all works out...because damn that's frustrating!
