Ex employer wont give me my P45
I left them on 30th june started a new job since, however, I have had to fill in a P46.

I had to call them and ask where it was, they said they sent it on 30th June.

Then I called them yesterday and they said that they have not sent it, because they think I owe them money, however it is only a small amount they claim I owe (they did not write to me either) however, they said that was the reason why they were witholding it.

They said they sent it yesterday, then they said that they sent it on 30th June!

They then said that they have to send me a statement of earnings.

Can they legally withold my P45?

Plus, will this cause me problems at the end of the tax year, as I have now been put on a basic tax code.

It's RBS I used to work for,

I have googled the CEO and have found out that the company have made a loss of £691MILLION!!!

Don't bother, you don't need it, forget them, when you get your new job just inform your tax office of your new employer and your old one, they will do the rest.

They cant withhold your P45, it is illegal and you should tell them that

The Company has witheld form P45 because your final pay/tax figures with them are not finalised. You will have to sort out with them the claim that you owe them money. It is not uncommon for form P45 to be witheld in situations like this.
Contact tax office, and ask to have emergency code 534L, on a week/month 1 basis issued for the time. Or you can sign form P46 with new employer, same result.

Well you have problems now because you are paying too much tax. You need to submit a P46 to your current employer. They should be able to give you one, or go to your local tax office. You just need to fill your name address and NI no on this. You will then be put onto your correct tax code. If you are not automatically rebated you will need to ask the tax office for a P6. If I were you I would be writing a letter of complaint to the company chairman detailing the problems you have had - go as high as you can!

visit your tax office, I had this with a ex employer and they refused to give me my P45, they cant do that

Why are you so obsessed with the P45???
The P46 has sorted out any tax issues you would have had.

Get a life and stop moaning.
