I made $12,000 in the past year and am a full-time student. I don't live with my father and he maybe provided me with $1,000 worth of support in the past year, yet he claims me as dependent. I know enough about tax laws to know that he really shouldn't be allowed to claim me because I don't pass the "tests," but I'm not going to fight he over it.
What would happen if I filled out my tax return and said I couldn't be claimed as dependent (this is true, I can't, but he still will do it)? Would I get in trouble? I'm only getting $35 back as is, and I would be getting $400 back!!! |

I think you have two questions here: a tax question and a moral question.
The tax question is likely very simple: if you are over 18 and you provided at least 51% of all the money used for your support last year (including money for tuition and other education expenses) then he is the one who is going to get "in trouble" for claiming you. If he provides half you support, consult a tax lawyer.
The moral question is a little more complicated: you took money from him...yes? You are coming out ahead -- $1000 - $400 = $600 to the good. Have you discussed the tax issue with him directly? What is his response?
The bottom line is that, as an adult, you need to learn something real fast: he who as the gold, rules. If you wish to be free and independant, you CANNOT take money from people -- for any reason. By accepting money from someone, even your parents, you are obligating yourself morally to follow their rules at least in part. |

If he isn't legally allowed to claim you, and from what you say he isn't, then if nobody else can claim you, go ahead and claim yourself on your return. You'll have to mail it in if he has already filed and claimed you, you won't be able to efile.he and you will each receive a letter from the IRS telling you that two people claimed the same person, and saying that whoever didn't have the right to the claim needs to file an amended return dropping the claim - then if nobody does, they'll investigate and decide who gets the exemption. The other person will have to pay back whatever he got by making the claim he wasn't entitles to, with interest and possible penalties. |

To claim you as a dependant he has to be providing 50% of your care/housing/money etc. He may be able to claim you if he is providing tuition, insurance, or housing. Even if he only gave you $1000 cash he may still be providing for you in other ways.
Bring it up to him. I made a deal with my parent's that they could claim me (when it was sort of iffy as to if they were providing 50% in school) that they would give me my share of the rebate they would get. I am a math geek and did thier taxes, and then my own. I determiend they could get much more back with the education credits than me, and convinced them to give me the $100 that I would have got if I claimed myself. |

Your social security number will be flagged by the IRS, and both of you will be sent a letter asking for proof of dependency (you will need to prove that you provided more than 50% of your own support, and he will need to prove that you didn't). It will also delay both of your refunds until they have it all figured out. You won't get into trouble, as you are not in the wrong. He is. |

He really shouldn't be claiming you. They have to have provided 50% of your support to claim you. I would go ahead and file or ask him for the $400 that you would be getting back from his return. |

ohhhh i have absolutely no idea, but i just wanted to let you know that i feel your pain!!! This is the first year, that my mom actually, by law - can't claim me, because i made too much $$. I'm 23! She always threw me some $ though bc she knew she was screwing me (lol) but she still got A LOT more than i would have gotten if she claimed me, instead of me claiming myself - maybe you can work something like that out with your dad? Good luck! i know how much it sucks!!!!! |
