The only circumstance this would be allowed is if the spouses did not live together the last 6 months of 2008. Also each would have to have paid over half the cost of maintaining a home for their own qualifying child who lived with them for over 6 months.
So if they lived together at all in the last 6 months they could only file as Married Filing Jointly or Married Filing Separately.

If you are married and living together, then neither of you can file as head of household - your choices are a joint return or married filing separately.
If you haven't lived together at any time after 6/30, and you have a qualifying child of yours living with you and you provide over half of the cost of maintaining the household, then you can file as head of household. If you have been separated since before 6/30 and each of you has a qualifying child living with you, and you each provide over half the cost of maintaining your own household, then you could both be eligible to file as head of household.
Two people in the same household can never both file as head of household, since it's mathematically impossible for two people to both provide over half of the cost of running the household. |

If you are married which it sounds like you are, you should filed as "Married filing jointly". Married filing separately is the least desirable filing status to ever use. |

You can get in a lot of trouble doing that, if you are married, the
correct filing status is MFJ, now if you separated or are divorced this
past year then either you or him can claim head of household,
whoever took care of the house/children for more than 6 months, but
the other person might claim separate/which has its disadvantages.
Check with your tax preparer for an estimate to see which is better.
But both of you CANNOT claim head of household. |

I would highly recommend not doing that. You will get caught, audited, and most likely fined for the error in the tax calculation. |

the only way is if they've been seperated fo the last 6 months of 2008 and both have a dependent in their household who they have supported over 50 percent of their living expenses and isn't claimed by someone else.
edit at least the last 6 months or longer. |

No, none of you can file as head of household.
For head of household you must not be married or did not live with your spouse for last 6 months of the year.
