sophielyn | Filing status married vs married filing separate? |
my husband makes 3x more than i do. is there any benefit to filing "married filing separate" returns. we have 4 children that are MINE from a previous marriage and i am desperate for financial aide for college tuition. we did not qualify last year because of his income. i think if i do not include him i will be eligible for pell grant for my children i cannot afford tuition and any advice would be appreciated!! |

You can file as married filing jointly (MFJ) or married filing separately. In most cases, it is better to file as MFJ. Read http://taxipay.blogspot.com/2008/02/filing-status-for-married.html |

Unless you are expecting his refund to be withheld for some reason, you are better off filing jointly. The grant people are going to check into household income anyway and if you lie or omit his info, you could be subject to civil penalties and possibly criminal ones as well. Sometimes filing separately can be beneficial on your state return, depending on where you live and your circumstances. |

I think the FAF setup takes total income into their computation. Married, filing seperate is usually used because of an offset against one or the others refund and to limit liability. It also means you cannot collect the CHILD TAX CREDIT or the EIC ( which in your case may be a no-go). Have you talked over with your spouse the financial situration and tuition needs and yada? You might also be able to obtain some scholarship funds from the school? Wish I could be of more assistance. Good luck. |

If you are married, the entire joint household income is generally taken into account for financial aid no matter how you filed your tax return. But check that out with the financial aid office of a local school before you file, to be sure. The FAFSA form, which is used to determine the expected family contribution, specifies father's/stepfather's AGI without saying anything about whether the mom and stepfather filed jointly or not, so filing separately would probably not change anything about their eligibility for financial aid including Pell grants.

Married filing joint is almost always gives more money in returns. This is ESPECIALLY true if you have children.
I don't think you can exclude his income when applying for financial aide. They may be YOURS from a previous marriage, but for tax purposes, they became his also when you married him. |

You will have to fill out to sets of returns and see which one is more advantageous. Most couples do worse when they file married filing separate returns, but the Pell grant may more than overcome the difference. |

In your case filing separately might be in your best interest. |

Do you care if your man has to pay additional tax? Married filing separately would require both of you to itemize...or not itemize..in general, you are better off filing married filing jointly...and having your man help you pay tuition..Save, save, save |

In almost every case it is better to file Married. I previously worked for a great CPA...you should give him a he would really be able to help you decide and help you save money. His number 304-425-3200. I'm telling you he will be your best bet. Firm's name is Kevin T. Worley CPA AC. He should be open today. |
