Fraud. Filing a tax return on a child they don't have.?
I have a friend who works, but gets food stamps through Welfare. She has a 3 year old child and has done taxes on him every year, except this year she went to do her taxes and the return got rejected because his social security number was already used as a dependent on someone else's tax return. Her son has been living with he since he was born. How can she catch these people?

I think it has to be someone who thinks she's completely dependent on welfare and they believe she doesn't file her taxes for that reason--so they could get away with filing her child as theirs...The problem is that she does work and now knows someone is doing this.

She lives with her husband. He works too. She went to file her taxes and they told her she could:
1. wait 6 weeks and mail in paperwork to fight it. She needed the money badly due to a recent loss of a job.
2. She could remove him and get her taxes right away.

you mean every year she has been claiming the son as a dependant on her taxes, (Not filing taxes for him, unless he has been receiving income or sizable interest/dividend income); You didn't mention the father? is he paying child support under an agreement that allows him to claim the child?
If not have her call the IRS, she probably received a ltter stating that he was denied on her return as a dependent, and of course that changed everything on her return.

The letter should have stated the reason and had a phone number to call, maybe she made a mistake and typed/wrote a wrong digit, that would cause a denial, I forgot all to write all my kids Socials on the form one year and got a letter similiar stating they denied my claim of dependants, It all got fixed by the simple phone call with me not having to send anything extra in. he just looked at the years before and corrected my return for me.

If it was not the case of a simple error on her part; it usually will turn out to be the Father, or a family member that felt they payed to its support so they were just going to claim it, which they would not be entitled to unless that was an arrangement, that also met the IRS rules pertaining to support, and living arrangement ect...

She can't catch them - but the IRS can and will. She should file her return claiming him, but will have to mail it in, she can't efile since someone else already claimed him. Both people who claimed him will receive a letter from the IRS telling them that two people claimed the same person, and saying that whoever didn't have the right to the claim needs to file an amended return dropping the claim - then if nobody does, they'll investigate and decide who gets the exemption. The other person will have to pay back whatever he got by making the claim he wasn't entitles to, with interest and possible penalties.

Maybe it's the father who filed? She should contact the IRS and discuss it with them. I'm sure that she has proof that she provides for this child year round. It's also possible that it's identity theft.

If she LIVES with her husband, based on the spotty info given, she should be filing married filing jointly or married filing separately. It sounds like someone is playing loose and fraudulent with the head of household definition. Why didn't she file her taxes as married filing jointly with her husband???
