Garnishing Income Tax return for missed child support payments?
How would I go about taking an ex partners income tax return and stimulus check for not paying child support. Child support has been ordered but not a single payment has been made.

Well in a perfect world you shouldn't have to do anything. But, knowing that not all people do their jobs correctly...you should contact the HRS (or whatever it is called in your state) and insure that a lien is filed.

Talk to the agency in your area that processed child support - they can file a form to have any refund taken.

File a complaint through your state's attorney general. They can request that the tax refund be offset.

If you are in the same state as the deadbeat parent, contact you local child support division and let them know the deadbeats info. They should take it from there.

It should come up in the IRS computers that the person owes child support but you can never be too careful!

You talk to the case worker for your child support case (check with your filing court if you don't know who it is). I had a period of unemployment when I couldn't pay my support and they automatically took the tax return monies I had filed for to take care of the back-payment, which was excellently helpful. The most important thing to do is keep in touch with the case worker.

Seriously, go on some kind of government aid.Then you'll get your child support. It sucks, it took me a long time to get child support from my child's father. My coworker was receiving government aid and Child Support Services went after her baby's father and got child support from him, but for people like me who aren't receiving any assistance, it can take a while. Just stay on them, and hope for the best. it's not fair at all, but I eventually received child support, and I also called and kept on them until something got done. I wish you the best

Your child support office has to request it from the IRS. You can't. You can ask your case worker if they are going to. But chances are they already have. Taking taxes for cs takes a while. When the IRS offsets someone's taxes for cs, they automatically hold that money for at least 3 months. Just in case there is an injured spouse form, or other "legal" dispute filed. It makes it easier to recover the money this way, if the money wasn't really supposed to go to cs. After the waiting period, the IRS will send it off to the cs agency that requested it, the cs agency credit's the account, then they send it off to you like any other normal payment. It can take around 4 months in total. I know that you said he hasn't made a single payment, but how far behind is he. In order for them to take his return he has to be at least $500 AND 3 months behind. If he doesn't meet both conditions, they can't legally take his federal return. Plus the cs office has deadlines too. If you just got your order anytime from Nov 07 until now, then the cs agency missed the deadline to ask the IRS for his 07 taxes. They can't take his return for 07, if he wasn't far enough behind as of OCT/NOV of 2007.
