**HELP!! My mom is trying to claim me!!!?
I am 19 yrs old (since 12-12-07.) I got my income tax, and my federal withholding is 1,800. If my mom claims me im only getting 535 returned. If she doesnt I get likw 1,200. I pay her $200/mo rent...Which is supposed to go towards the taxes on the house (so she says.) Now shes trying to claim me for earned income credit. I asked her is she going to pay me the difference for what im going to lose? She said no its going toward her taxes on the house??? Im so upset about this. Its supposed to be a downpayment on a car. She knows how excited I was about buying a car...and now shes screwin me over. (oh and my sis (age: 21) lives here with her baby (age: 1) w. her bf. They pay NO rent...my mom is a 24/7 bbsitter. Here is the rub...

If your mother doesn't contribute more than 50% of your support, she can't legally claim you as a dependent.

You can report her for tax fraud, which would mean you must find another place to live. You have to decide if it is worth all the problems.

Is she claiming the $200 you pay her as income? Because if she isn't and you claim the renter's credit, she will likely get caught. Make sure she understands that you will be claiming the renter credit, so she needs to claim the income. She may change her mind on her own...

But either way, you may find yourself having to look for your own place.

If it were me, and I had receipts, I would not alter my return to agree with her falsified one.

If you claim yourself you should be prepared to move out. I guarantee it costs you mother more than $200 for you to live in her house. Respect our Mom, grow up, be a man and move out. I bet there is more to your situation than your telling.

I was in this situation as well when I was younger. But depending on how much she made in 2007 it may be worse for her claiming you than you claiming yourself, but it all depends on allot of things. And the fact that it's "going to taxes on the house" sounds fishy, did she not pay the right amount of taxes during the 2007 year?

I'm sorry this is happening, I feel your pain cause i was there until i finally moved out on my own. At least $535 will be better than nothing and enough for a down payment on a small slightly used car.

If you aren't in college fulltime she can't legally claims you after 18. If you file and claim yourself she is the one that will get in trouble!!! If you are a full time student and she is supporting you she can claim you!

not to be harsh...but suck it up bro,it's your Mom,she gave birth to your scrawny butt.200 bucks amonth for rent is WAY cheap you shoulda been able to save a few bucks over the past year.I know how you feel but this woman is probally struggling her a** off to support all these ppl in her house.Do your best to help and realize you're pretty much on your own and figure out what you are gonna do with YOUR life. :)

Well, does she support more than 50% of all your expenses? Do you buy your own groceries? Your own clothes? Your own laundry, etc? Guess what?? $200 a month is not even hardly close to what rent costs, so consider yourself lucky. Maybe your mom is struggling with bills, have you ever asked her that? You're too old to be actling like this. Stop being a selfish brat and help your mom out! I'm sure she's done a lot for you, like , ahem, let you loive in her hom while you're over 18 for only $200 a month. If you want to claim yourself, why don't you move out and support yourself!!

She can still claim you because she supports you over 50% in total and you live under her roof. actually anybody that lives there she can claim. Nothing you can do about it. But she does need to report the income she gets from you in rent. $535 is better than nothing. Go see a tax person to see what you can do.

Technically if you claim for yourself she is not legally aloud to claim you. Talk to a tax representative for what you can do. I'm sure they'll catch your mom and she'll lose out on that. Once someone starts filing their own taxes they can no longer be claimed by a parent.

See, I need to figure this out....I was told last year by H&R Block that I couldn't claim my 16 year old this year for the earned income credit. So, maybe your mom legally can't claim you on her taxes because you are too old.

If I were your mom I'd sure as heck try to claim you though because I support you!!! I'm sorry.

there's a thing on the tax form that says are you a dependent in a household...put NO, that way you get your 1200 and your mom gets her money and if she gets audited she messed up because you told her in advance you were gonna file as independent.

She cannot claim because of the following conditions

A child is your qualifying child for dependency if all six of the following tests are met:

Relationship Test - Your qualifying child must be your:
Child (son, daughter, stepchild, adopted child, or eligible foster child) or descendant (for example, grandchild or great grandchild)Sibling, half sibling, stepsibling, or descendant (for example, nephew or niece)

Age Test - Your qualifying child must be under age 19, a full-time student under age 24, or any age if permanently and totally disabled.

Residency Test - Your qualifying child must have the same main home as you for more than half the year. Special rules may apply for kidnapped children and for temporary absences due to special circumstances such as illness, education, business, vacation, and military service.

Support Test - Your qualifying child must not provide more than half of their own support. For full-time students, amounts received for scholarships at an educational organization are not considered amounts paid for support.

Because you work and make more $3050 a year, you are not qualified as dependent. You are independent or self-support. If your mom claims you and you file as independent, based on the above rules, your mom will be audited and must prove to the IRS that you are dependent.
