Yes, and you can get 100% of your charges back. There are 5 steps to the process:

1) Get a copy of your charges or statements for the last 6 years using a "Subject Access Request" under the Data Protection Act.

2) Go through your charges and total the ones you can claim back.

3) Write to the bank asking them for your charges back

4) Send the bank a "Letter Before Action", giving them one last chance to pay before you take them to court.

5) File a claim in the Small Claims Court (which can be done over the internet using the Money Claim Online website, run by the court service).

Obviously, you only go to the next step if the bank don't make you an offer you are happy with.

my sister is in the process of doing so! she has drawn up a letter stating exactly what they have charged her etc and she intends to take them to a small claims court! hope she does get it back! lloyds bank!

Claiming back your bank charges is not as easy as some sites make out. It is not just a case of sending a letter and you will get a cheque back in return. There can be a substantial amount of work involved including issue Court claims, preparing necessary court papers and legal arguments, replying to defences from their solicitors etc. If you are not confident with the strategy it is likely the banks will use their "bully boy" tactics to try and get you to drop your claim or accept a greatly reduced settlement amount. You may need to also look at other issues like 'debt in dispute' 'default removal' issues as well.

There is plenty of free help available at http://www.consumeractiongroup.co.uk or http://www.penaltychargesforum.co.uk and other sites.

If you feel you do not have the will or battle nerves to do this on your own, there are other comapnies out there will will do the work for you, but they will charge you a fee from any settltment they get you from the bank. One such company is http://bankcharge-refunds.co.uk

You have to make the choice on whether you have the time, patience and steely nerve to tackle the banks and solicitors by yourself, or use one of the no-win no-fee companies which exist.

Yes, and yes!, moneysavingexpert will help with how to go about it, make sure you have another current account with another bank first though, some banks hae been paying out and closing accounts - which again is unlawfull and likely to get them hammered by the financial ombudsman but they're doing it anyway.

Go to the money saving expert website there you can watch a video explaining how to go about it. It is very simple to do,my son and daughter have started the process dont worry you cant lose.
