He hasn't paid taxes for a few years?

Too bad he's not an "illegal alien." The plan is to give them an opportunity to pay two of the past five years' taxes, plus a small fine, and to call it even! Great country!

Is he receiving tax notices from the IRS saying that he owes money? If so, he needs to set up an installment plan asap as interest and penalties will accrue every day the debt is not paid back. They will work with him. However, this can affect his credit. If he has received notices he must deal with them, and the sooner the better.

Your sister should definitely not file jointly as this will become her burden too.

If you're concerned that he hasnt filed tax returns, but arent sure if he owes money, then you dont know how much is owed until he actually files a tax return. In this case he needs to submit tax returns (no matter how late) and figure out how much money he owes. Tell the tax preparer to calculate the interest and penalties also owed on the tax due.

Obviously he is self-employed (because if he is employed, his tax will be withheld). I wouldn't worry. One thing you can do is to bring up the subject in front of his future spouse.

p.s. If the future spouse already knows, contact HR Block, pay them a few hundred dollars and file back taxes. He just have to provide information to them. Tell you sister to file "married filing separately" until his taxes are all paid up.

Well, he and his wife (your sister) should keep separate incomes, properties, debts, taxes, and son.

His wife (your sister) should also learn to stand by her man, even if it means going down with him.


As for his taxes.

That's his own business if whether or not he has paid his taxes. But if he wanted to pay his taxes and wanted help, then the whole family should help him.

A family meeting (discussing, filling, payment plan, etc) might be needed, and as it has already been said here, a tax specialist (preferably one that is close to the family or even part of the family) can help the filling.

He should come clean with the service but your worries about your sister and his back taxes are unfounded. They were not married and can't file a joint return for those years. She is not on the return so they can't touch her assets, or do anything else to her.
The problem comes in the future. 1. will he file, if not she either has to make sure they file or she should file as married filing separate. 2. she should not put any money in a joint account or an account in his name as the service could attach these accounts to get their due.

Two words: Butt out. Why should you or anyone else pay this guy's taxes? If he and the woman he is marrying are of legal age, then really, it is THEIR problem. I would get a life of your own and stop worrying about it.

I would discourage my sister from marrying anyone like that!!

Tax evasion could be just the tip of the iceberg !! AND it is no joke... The IRS is NOT like a collection agency where they call you and bug you... The IRS shows up and moves you out!

Save your sister at costs !!

Start with a tax specialist. File back taxes. Maybe he could even work a deal with the IRS so he wouldn't have to pay the full amt.

Or, contact the IRS and tell them you need to pay back taxes.
