Help! Baliliff problems re council tax?
nightmare please help . i moved and went bankcrupt in 2005 i am stuggling to prove that i was not at the address. with the council and got a baliff asking for 1400 by the end of the week he is being upfair and not allowing me to pay in installments and wants to take my stuff . how can i stop this at such a late stage in happening he will not accept 300 a week until we sort things out .council will not put a hold on things to stop him coming is there a way out ?

Unfortunately Wilfred B is not quite correct . If the account is returned by the bailiff then the council can either write off the debt, accept an arrangement, issue bankruptcy proceedings, issue a charging order or go for committal action.

If you where bankrupt after the date the council tax is for then you need to inform the council of this as it needs to be done through your bankruptcy administrator.

Best practise would have them hold the account for a week or two if you have evidence you lived elsewhere - why not contact the L/A where you lived and ask for proof that you lived their ?.

Was the property you lived in rented ?, if so the L/L should be able to provide the required proof - tenancy agreements etc.

Go to citizans advice, but you will be able to go to court and have them check the payments are fair.

Didn't you write to the council when you moved saying you no longer lived there. If you don't write the bills keep coming.

these nasty little b------s shoud get a proper job maybe working in a hospital or a charity shop. at least they will be helping others rather than kicking them when they are down. dont invite him into your home cos once he is in he can take stuff. you forgot to tell the other bit that your friends own everything in your property and you have had to borrow it all cos you cant afford to buy your own. they cant take what you dont own.

Are you trying to say you had paid your council tax and the bill is from the person that moved in after you? if that's the case have you got a rent book or something that shows when you started paying rent on where you live now.
If it is money you owe you should of been able to go to court with a list of income and expenditure and then you may of been given the chance to pay it back in instalments.Did you ignored the letters. As for stopping the bailiffs i don't know as you can I'm afraid.

well to be fair you cannot or should not have articles of value that the baliff can take.
it will all depend on what items of value you have in the home that a baliff can legally take
briefly he cannot take normal furniture or any tools you require to earn a living with.
he cannot take you car for instance you are a taxi driver and taxi driving is you primary employment.
if you use a computer for your employment he cannot take that either.
in all probabilty they may be very little of value in your home that he can lawfully take
if you have a large screen tv either lcd or plasma he can take that but you have to own it outright if it is on finance or rental he cannot.
anything you have in the house that is on hire purchase they cannot be taken either.
anything that is jointly owned with somone other than your spouse also cannot be taken.
when he returns later in the week and before he gets to your home remove any articles of value you may have that are not covered under the points I have already made.
dont offer any money and let him in the house if you have nothing of value that he can legally impose a lien on he is basically on a now in "no win situation."
he will mark the baliffs warrant "NO EFFECTS" and you will probably never see him again. the council then will have to accept any offer you make because they will know by then it is the only way they will get the money in the long run.

Its hard, the council won't support you because they have handed the case to the bailiffs, basically you have to pay them or they'll come and bust your door down and take your stuff. This is why it is important to keep all documentation because if you have a legitimate case, you can claim the money back.
