 How can I turn someone in to the IRS for not taking taxes out on an employee?

Help with council Tax?!?
I moved into my new flat in Nov 2005 and have paid the man who owned the bulding rent every month , assuming that the council tax was being payed. he lives in another country and assumed that I was paying it myself.

I found out last year that i had to pay it. I have made many attempts to pay it but it have always had trouble getting a decent response from the local council.

Now, I am being forced to pay council taxfor the flat for the past 3 years because I can't convince them was living with my parents.

I will pay it from Nov 2005 but can anyone give me any tips on how to deal with this without getting scammed by the council?

Bank statements, credit card statements sent to you at a different address at prior to 2005. If you don't have originals you can get copies from bank.
Anything else "official" with your address.

Isn't it up to the council to prove you were there rather than you to prove you weren't? I would happily let it go to court to see how substantive their evidence was.

Show them your Tenancy Agreement, the contract will show your tenancy began in Nov 05 and not before. You can pnly be charged for CTax from the first day your tenancy began.

Get a copy of your tenancy agreement, it should have the date you moved in on it.
If you've lost it and are unable to get a copy from him I advise you get in touch with the Citizens Advice Bureau ( C.A.B ). They can give you free legal advice.

I really sympathise with you, my last landlord rented the flat to me with the understanding that the tax was included in my rent. However, after 1 yr the council got in touch informing me it hadn't been payed. At the time I wasn't in a financial position to sort it out. I left the property, went to the CAB with the newspaper advertisement and my tenancy. When he realised I wasn't tacking any crap, he stopped per-suing me for it.

You need to pay the tax back from Nov 05 unfortunately, however, ask CAB were you stand, if the landlord hasn't informed you or the council you are living there then you may not need to back pay the tax at all, it may be his responsibility.

YOU MUST HAVE A SIGNED LEASE FOR THE FLAT OR A CONTRACT OF RENTAL WHICH WILL PROVE THE DATE YOU MOVED IN, YOU ARE ONLY RESPONSIBLE FROM THIS DATE, IF THE FLAT WAS VACANT BEFORE YOU MOVED IN THEN THE OWNER IS RESPONSIBLE FOR ANY COUNCIL TAX OWED BEFORE THAT DATE. IF NOT THEN THE PREVIOUS TENANT IS RESPONSIBLE AND IT IS THE COUNCILS RESPONSIBILITY TO PURSUE THAT DEBT NOT YOURS.

well firstly phone up and arrange an appointment with an advisor. when you go in take your tenancy agreement with you and state you are happy to pay the councill tax you owe. usually this will sort it out for you, meanwhile you could send them a letter outlining you are willing to pay your councill tax but obviviously not before you were in that property, writting letters is valuable so you always have evidence to support your case. this happened to me, i was a student and exempt from council tax, i went in with my exemption form 3 times and they still billed me, so i sent them letters, it kept happening so i arranged an appointment and it all got sorted out in the end! but good luck with it all.

Councils are vicious when it comes to "defaulting" on your council tax. It is up to YOU to prove when you moved into the property, they have no burden of proof. You need to provide them with your original tenancy agreement showing the date you moved into the property. This is the only way they will accept.

Trust me on this, I've been in this exact situation myself many years ago. I had even further trouble because my original tenancy agreement was typed up by the landlord using different type-faces, and the council kept insisting it was a fake.

You need to provide every shred of evidence you can that you moved into the property in November 2005. If you can't, they can have you for however long they want. No it's not fair, but unfortunately they are the ones holding the power.

Firstly, councils are not out to scam you! And, in the legal pecking order, the tenant always pays the council tax except in a house of multiple occupation. So you had a legal obligation to register yourself when you moved in, no ifs, no buts. My advice? Go see your local friendly council tax officer, take proof that you physically moved in November 2005 ( tenancy agreement, utility bill or the like ) and simply ask them to bill you correctly from that date. I suspect that they have billed you from when the last tenant moved out or the last activity ceased on that property, councils do this by default ( because people don't always tell them! ) and you simply need to prove and state you case. Once that is agreed, you will have some hefty 'immediately due' amounts built up before April 2007 and you must simply ask the council to agree an instalment plan to cover old and new ( 2007/8) charges. Councils should be reasonable in this case although you have been the author of your own misfortune I am afraid!
Yeh, of course it sucks but doesn't everything? Oh, and don't forget to request a single person discount if you lived alone for all or part of the period to date ... councils have to take that on trust and on your stated declaration.

Everyone has trouble with there Council , ask to see someone and explain your situation , they will tell you what to do ,
After they have told you what the bill is , and that you are happy that it is correct, then ask for time to pay.
They will not like it but after all , if they did there job in the first place, you whould not be in the mess you are.

And yes beware they will try it on , get further advise from C.A.B
