Grisham | How can I get out of my taxes?? |
I'm a massage therapist on a 1099. How can I avoid taxes?
Is it possible to not pay them and hope they don't check me? |

If you receive income reported on Form 1099, IRS receives a copy of it too. If you don't file a return, IRS will do it for you. You will not like the result.
On a related subject, I question whether you should be classified as an independent contractor getting a 1099 or an employee getting a W-2.
Some employers try to get around paying employment taxes (social security and unemployment) and other employee benefits like workers compensation insurance by improperly classifying employees as independent contractors. The basic issue is the amount of control the employer has over the worker. If you are required to show up for work--personally--at a particular time, punch the clock, use the employer’s equipment and are paid an hourly rate, or another set rate based on time served, you are an employee. If you didn't understand the difference when you posed your question, I would be even more convinced that you are an employee. What is your preference, Slotted or Phillips? Complete an IRS Form SS-8 to get an official ruling on your status. This will help you get unemployment if you get fired. When you file your income tax return, you can attach Form 8919 Uncollected Social Security and Medicare Tax on Wages and only pay the employee's half of social security. You will still have to cough up all the income tax. IRS and the states are stepping up enforcement in this abuse area. |

You could give up your citizenship and move to another country - but check first what their taxes are, since many countries have higher taxes than the US.
It's possible just to not file. Eventually when you get caught, you'll owe a lot more that if you had just paid in the first place, and if you don't have the money, any assets you have will be seized. And the clock doesn't start running on the statute of limitations until your return is filed, so they can go back as far as they want to. Do you really want to live your life looking over your shoulder waiting for the IRS to catch you and ruin whatever you have? |

First lets distinguish between avoiding taxes and evading taxes. The first part of your question wants to avoid taxes with the legitimate expenses of a self employed person. Things like equipment used in the massage such as a table and any repairs to it can be deducted on your schedule c. Rent, electricity and telephone expenses related to your business are all legitimate deductions that will lessen your tax liability and help you avoid a higher tax liability.
The second part of your question deals with EVASION which is illegal. The IRS has a matching program so when the person sends you the 1099 he also sends a copy to the IRS which then will wait for you to file a return. If you don't file a return they might not catch up with you right away but they won't forget that 1099. Eventually it will get matched with your social security number and as your life changes and you do different things it will catch up to you. When it does there will be late penalties, and worst of all, interest, compounded daily, which can effectively enslave you for life to the IRS. Bankruptcy does not protect you from the IRS. They are first in line at the bankruptcy courts. Talk with a tax attorney. If you are not making it as a massage therapist raise your prices or get out of the business. I used to collect taxes and know a little bit about the business. Good luck. |

you can go without paying but believe me they will find you and you will have bigger issues to deal with
as long as you have your ss#, they will track you down (bank account, residence, etc)
If you have to pay taxes then call IRS and set up a payment plan; they WILL work with you on paying your taxes |

Pay taxes, its against the law not to, avoid the trouble.
If you don't pay it and owe money when you do decide to file in the future you will have a hefty amount to pay! and you will be penalized and fined. |

you can of course not pay them, and hope they don't catch you, but that is a fool's hope. If you have a bank account or ever cashed a check the IRS knows who you are, and what you make (approximately), and they WILL eventually catch you. It is a federal offense to evade paying taxes, and it does involve considerable prison time, so I suggest you grow up and realize that in this country death and taxes are unavoidable. |

We're in the same boat. I don't know how I'm going to come up with the money to pay my taxes for last year. I also worked as an independent contractor for part of the year and received a 1099.
You have to pay your taxes. I don't see how you can get out of it. The company that sent you a 1099 also sent a copy to the IRS. The IRS knows what your were paid last year. This is how the system operates. The law is written to favor the IRS. If you don't file a tax return you could get into big trouble. It's just not worth it.
There are things that you can do to reduce your tax burden. First, you could contribute to a traditional IRA. I believe this year the amount you can contribute is $4,500.
You can also deduct legitimate business expenses.
I think you need to find a good CPA to help you out. Good luck. |
