There are two issues here - the employer not submitting the withholding to the government, and your concern about not getting a W-2. Are you sure they're not turning in the money, which is definitely not legal, or is it just that they told you they have until January to give you a W-2, which is correct.
The IRS says the employee is not PENALIZED BY THEM for what the employer does, but they should be real interested in this info of what the employer is doing. The employer is required to pay the withholding to the government at least monthly, is NOT allowed to keep until January. They have to give you a W-2 by the end of January.
If you have good reason to believe they aren't depositing the money as required, and have called the IRS about this and they have ignored you, call 1-877-777-4778 and ask to talk to a taxpayer advocate and explain the situation. |

They are required by law to provide W-2's by January 31 or they are in violation of Federal Law. I'd ask another IRS person. |

First have you ever filled out a w-4 which tells the employer how many deduction you want? If not you need to do so.
Example: S-0 (single with no dependents) this will take the most taxes out of your paycheck. |

If you're a legal citizen, you need to get a w-2 (or form 1099) by January 31 each year. If you don't, call the IRS.
Plus, go work somewhere else. Quit before the company (which seems to be poorly managed) goes out of business. |

That's illegal. They are stealing. Even a self-employed individual is required to submit quarterly taxes so the IRS gets the money earlier. If you're sure they're not sending in the withheld money, then report them to the IRS. But how could you know for sure? |

contact the irs imediately employer must provide W2 by jan 31 make sure you have all your paystubs showing the deductions you will need them both as evidence that your taxes were withheld or else the irs is coming after you --your employer is breaking the law |

If they are doing this it is illegal and you should turn them in or quit. By law they must pay the state department of revenue all sales tax. The IRS will come after them for their portion of taxes. Call the IRS pronto. |
