Do you know for a fact that he claimed the three of you?
If the three of you are under of the age of 19 at the end of the tax year or under of age of 24 and a full time student for at least five months of the tax year and did not provide over half of your own support you are the qualifying child of both your mother and father. It does not matter who supported you in the test for a qualifying child. HOWEVER, the tiebreaker rules states the parent who the child lived with the longest during the year is the parent who can claim the children.
Your mother should file a return and claim any of you that is her qualifying children and when/if the IRS contacts her she will have to complete a worksheet providing proof they lived with her.
If any of the children do not meet the age requirement above but did not earn over 3,400 of gross earnings and she provided over half of your total support she can still claim them as a qualifyng relative. |

He doesn't "get money from you" If you mean he claims you as a dependant then your mom should divorce him & get the right to claim you on her taxes. She should also get an order for child support since you are still in school.
I saw where someone said your mom should just claim you- that could end up getting her in a lot of trouble! If dad and mom both claim you then there is a MAJOR issue with the I.R.S. since he has already claimed you this year & has I assume for the last few years it looks like it's his right (even though I agree that its not morally)- Mom needs to take a stand & get some legal help to get her rights.
Also if you work, look at the IRS guidelines before you file your return- If he has the right to claim you (legally) you have to answer the question on the return - can anyone else claim you as a dependant on their return? with a yes answer. Otherwise you will receive more of a refund than you should & end up having to pay it back plus penalties & interest.
RUN - don't walk to a divorce attorney. Your dad is pretty low down. |

How does the money belong to you? That is the problem with America. Every body has this sense of entitlement for stuff that you have no claim to. He worked and paid in taxes, therefore it is his money not yours. Good news is whatever you paid in you should be getting back. If you need more money than that you should go out and get a job. You are going to say oh I am in collage and don't have time. Do you have classes every minute of the day? You just want to be lazy and have something handed to you. |

He's taking you as a deduction when he's not entitled to -- that's wrong of him, but if anyone is upset about it, it should be your mother, not you. If she's the one supporting you, she should be claiming you as a dependent on *her* taxes, and *she* -- not you -- should be getting the deductions for you and your sisters.
When she files her taxes, she should submit the forms by mail rather than e-filing, and she should definitely claim you and your sisters. The IRS will see that two people are claiming the same exemptions, and then they will contact both of those people to find out what's going on. At that time, all your mom will have to do is prove that you live with her and that she's supporting you, and the IRS will take the tax benefits away from your dad and give them to her.
None of this will help you pay for school, though. You'll have to figure out some way of doing that on your own. |
