How can you fix it if you don't do your taxes for years?

something happened the first year and he was going to owe-so he hasn't done them since. He was planning on claiming my daughter and put her as dependent on his W2's and didn't tell me till right before taxes when I told him my mother claimed her. Just do them. He won't go to jail, he'll just pay some interest and penalties for late filing if he owes money.

If he's getting refunds - there is no penalty. But if he doesn't file within three years for the original due date of the return, he'll lose his refund - they IRS will get to keep it.

Simply file for the last 3 years. He will have to pay his taxes plus penalty and interest, but the IRS will probably happy with that. At 3 years, the IRS will soon be on to him if any W-2s or 1099s were turned in. so it is better for him to do it than to wait for the IRS to find him. If he more was with held than what his tax liability was, he could actually get a refund

He doesn't turn himself in to anybody. He just needs to file the back returns. If he can pay what he owes when he files, he should send it in with the returns. If not, he can set up a payment plan.

Unless your daughter is his biological daughter, he can't claim her anyway, whether your mom claimed her or not, and you can't give him permission even if you want to. He could only claim her if you had no income, and the child lived with him ALL year and he provided over half of her support.

All he has to do is to do his tax for those years now. Contrary to popular opinion, there is no deadline after which you cannot file. At worst, late filing results in either a penalty (a % added to what you owe) OR a delay in your refund (not both for the same year). Simply download the forms for the years for which he did not file from http://www.irs.gov, enter the required information, and mail them.

I agree with all your answers.

File as "Single" no other dependents

You can take your papers with you to the IRS and they will actually help you file. If you are close to an IRS office.
If not, file yourself. Include copies of your W-2,s if you have any. Better that you file than wait for them to "File for You".Then you'll have real problems.
Check your bank statment deposits to make sure you don't forget any income other than W-2, or 1099



You can't fool these people. You're too young to get on their "list"

There is no jail time here, You just need to show IRS,the lst three years of your income if you have some other wise, you need to fill all three years. Go to an accounter. they have the form and they help you with it.

Providing his reason for not returning his taxes for the last 3 years is legitimate and not an attempt to fail to declare or attempted fraud, or attempt to hamper child support responsibilities he will probably just be given a fine.

I would recommend that to keep it all above board that you use the services of a qualified tax accountant who will make sure all the Ts are crossed and the Is are dotted.

You do NOT want one mistake on this return.

He has become a "non filer". Not a crime.

The real question is, does he owe? If he does not owe, then he has no tax liability and has no worry.

If, on the other hand, he owes, then he needs to see the IRS and work it out. If he does not, they will get very nasty.
Oof course, this would only be if he can pay. They never waste resources on folk who are broke.

If he has an income, he should see an accountant and have his liability estimated. then fess up. Or, wait for an audit. The audit will be more difficult. The IRS will not kill him. But, they can take away everything.

If you and he have nothing to lose, then be silent. It's only money. If you stand to lose, go talk to an accountant and the IRS.
